On December 7, 2022, the Ministry of Labor - Invalids and Social Affairs of Vietnam issued Notification 5034/TB-LDTBXH regarding the Lunar New Year and National Day holidays in 2023 for officials, public employees, and laborers.

Based on the direction of Deputy Prime Minister of the Government of Vietnam Vu Duc Dam in Official Dispatch 8056/VPCP-KGVX on December 1, 2022, of the Office of the Government of Vietnam regarding the Tet Lunar New Year and National Day holidays in 2023 for officials, public employees, and laborers, the Ministry of Labor - Invalids and Social Affairs announces the holiday schedules for administrative agencies, career organizations, political organizations, socio-political organizations, enterprises, and other employers as follows:

For officials and public employees in Vietnam

- Officials and public employees, and laborers of administrative agencies, career organizations, political organizations, socio-political organizations are entitled to the Tet Lunar New Year 2023 holiday from Friday, January 20, 2023, according to the Gregorian calendar (29th day of the lunar December of the Year of the Tiger) until the end of Thursday, January 26, 2023, according to the Gregorian calendar (5th day of the lunar January of the Year of the Cat).

This holiday period includes 5 days of Tet Lunar New Year holidays and 2 compensatory days off for weekly rest days as stipulated in Clause 3, Article 111 of the Labor Code.

- Officials, public employees will have the National Day holiday in 2023 from Friday, September 1, 2023, until the end of Monday, September 4, 2023, according to the Gregorian calendar. This holiday period includes 2 days of National Day holidays, 1 weekly rest day, and 1 compensatory day off for a weekly rest day as stipulated in Clause 3, Article 111 of the Labor Code.

- Agencies and units implementing the Tet Lunar New Year and National Day holidays in 2023 should arrange and organize departments to work reasonably to ensure continuous problem resolution and efficient service to organizations and the public.

- Agencies and units that do not have fixed Saturday and Sunday weekly rest days will base their holiday arrangements on the specific programs and schedules of the unit to arrange suitable holiday schedules.

For employees in enterprises in Vietnam

- For employees not specified in Clause 1 of Notification 5034/TB-LDTBXH, employers will decide on the option for Tet Lunar New Year and National Day holidays in 2023 as follows:

+ For the Tet Lunar New Year holiday: choose either 1 day at the end of the Year of the Tiger and 4 days at the beginning of the Year of the Cat, or 2 days at the end of the Year of the Tiger and 3 days at the beginning of the Year of the Cat, or 3 days at the end of the Year of the Tiger and 2 days at the beginning of the Year of the Cat.

+ For the National Day holiday: Saturday, September 2, 2023, according to the Gregorian calendar and choose 1 out of 2 days: Friday, September 1, 2023, or Sunday, September 3, 2023, according to the Gregorian calendar.

- Employers must notify the Tet Lunar New Year and National Day holiday plans to employees at least 30 days before implementation.

- If the weekly rest day coincides with the holiday stipulated in Clause 1, Article 112 of the Labor Code, employees are entitled to a compensatory weekly rest day on the next working day as stipulated in Clause 3, Article 111 of the Labor Code.

- Employers are encouraged to apply the same Tet Lunar New Year holiday period for employees as stipulated for officials and public employees.

Other holidays and Tet holidays are implemented according to the provisions of the Labor Code.
