Not Knowing Whose Fault It Is but Abandoning the Victim Is a Violation of the Law

Recently, there has been a stir and outrage on social media regarding the incident in which three young women in Hanoi were hit by a Mazda driver. Following the accident, the three women requested to be taken to the hospital, but the driver pushed them out onto the street and then left. The true nature of the incident is only known to those involved.

According to received sources, the main cause is due to these girls riding rashly on motorbikes and colliding with the front of a car, resulting in injuries. The car driver believes that the accident was caused by the three girls and they only suffered minor scratches, so he refused to take them to the hospital for a checkup.

Fortunately, the accident was not serious and no one's life was in danger.

It can be seen that the actions of this driver are very callous, meaningless, and lack morality. If the accident had been more serious or if the driver had left when the victim was in a critical condition, would the driver still be so indifferent?

Acts of neglecting an injured person or committing a hit-and-run can constitute a crime as prescribed in the 1999 Penal Code as follows:

"Article 102. Crime of not aiding a person in a life-threatening situation

1. Anyone who sees another person in a life-threatening situation, yet has the conditions to help but does not assist, leading to the death of that person, shall be subject to warning, non-custodial reform for up to two years, or imprisonment for three months to two years.

2. Committing the crime in one of the following cases shall be subject to imprisonment from one to five years:

a) The person failing to help is the one who unintentionally caused the dangerous condition;

b) The person failing to help is someone who, by law or profession, has the duty to help.

3. The offender may also be banned from holding certain positions, practicing certain professions, or doing certain jobs for one to five years."

Or

"Article 202. Crime of violating road traffic regulations

1. Anyone who operates a road vehicle and violates road traffic safety regulations, causing harm to life or serious harm to the health or property of another person, shall be fined from five million VND to fifty million VND, non-custodial reform for up to three years, or imprisonment for six months to five years.

2. Committing the crime in one of the following cases shall be subject to imprisonment from three to ten years:

a) Without a driver's license or certificate as prescribed;

b) While intoxicated or under the influence of strong stimulants;

c) Causing an accident and then fleeing to evade responsibility or intentionally not assisting the victim;
