This is one of the notable contents specified in Decree No. 161/2018/NĐ-CP of Vietnam’s Government providing amendments to regulations on recruitment of officials and public employees, officially effective from January 15, 2019.
Specifically, according to Clause 1 Article 1 of Decree No. 161/2018/NĐ-CP of Vietnam’s Government amending Article 4 of Decree No. 29/2012/NĐ-CP, conditions for official recruitment registration are set out in Clause 1 Article 36 of the Law on Officials of Vietnam. Depending on each working position, the recruiting agency shall determine other conditions according to Point g Clause 1 Article 36 of the Law on Officials provided that they must not be contrary to law regulations, without regard to training mode, qualifications, certificates, and public or private training institution, and reported to the official-managing agency for approval before the recruitment.
Concurrently, according to Clause 1 Article 2 of Decree No. 161/2018/NĐ-CP of Vietnam’s Government amending Article 4 of Decree No. 29/2012/NĐ-CP on conditions for registration for public employee recruitment, depending on requirements of each working position, agencies/units competent to recruit public employees as prescribed in Clause 1 Article 24 of the Law on Public Employees of Vietnam shall determine other conditions according to Point g Clause 1 Article 22 of the Law on Public Employees provided that they must not be contrary to law regulations, without regard to training mode, qualifications, certificates, and public or private training institution.
Thus, according to the above regulations, it can be understood that from January 15, 2019, there will no longer be a distinction between a regular degree and an in-service degree, a distance training degree, etc. when recruiting civil servants and public employees.
