Newest regulations on the election result calculation in the Communist Party of Vietnam

On October 10, 2024, the Central Executive Committee issued Decision 190-QD/TW concerning the election regulations in the Communist Party of Vietnam, including provisions on the procedure for electing the Secretariat that will be applied from October 10, 2024.

Specifically, the regulations on election result computation in the Communist Party are stipulated in Article 30 of the Regulations issued with Decision 190-QD/TW 2024 as follows:

- Election results are calculated based on valid votes; valid votes are defined in Article 15 of the Regulations issued with Decision 190-QD/TW 2024.

In cases where multiple candidates are elected and no surplus exists, if the voter marks X in both the agree and disagree boxes or does not mark X in either box corresponding to the name of a candidate, the vote for that candidate is not counted (the ballot is still considered valid).

- For party member congresses: Elected candidates must receive more than half of the votes compared to the total number of official party members of the party cell or committee summoned, excluding members temporarily transferred to other party cells, those exempted from party activities and not present at the congress (if they are present and participate in voting or resolving, they are counted), members suspended from party activities, under prosecution, indictment, or detention, and official members absent for valid reasons approved by the party cell committee.

- For delegate congresses: Elected candidates must receive more than half of the votes compared to the total number of official delegates summoned, excluding those committee members absent during the whole congress, or official delegates absent without substitutes.

- At executive committee meetings to elect the standing committee, secretaries, deputy secretaries, inspection committees, and inspection committee chairpersons, elected candidates must receive more than half of the votes compared to the total number of committee members, excluding those temporarily transferred and absent from the meeting, suspended, prosecuted, or detained.

- If more candidates receive more than half of the votes than needed, those elected are the ones with higher votes, taken from highest to lowest until the required number is reached.

- If the last position on the elected list has multiple candidates with the same number of votes, exceeding the needed number, the chair or presidium of the congress (or meeting) creates a list of those tied for votes to elect again, taking those with higher votes without requiring more than half. If the vote remains tied, whether to hold another election is decided by the congress (or meeting).

Regulations on Election Forms in Vietnam

* Secret ballots are used in cases:

- Electing the executive committees of party cells (referred to as the committee); electing the Central Executive Committee of the Communist Party of Vietnam.

- Electing the standing committee, secretary, deputy secretary of the committee.

- Electing the Politburo, General Secretary, Secretariat.

- Electing the inspection committee, chairman, deputy chairman of the inspection committee.

- Electing delegates for the congress of the higher-level party committee.

- Collecting opinions on candidates to be included in the election list.

- Nominating party members for leadership positions in the State, Fatherland Front, political-social organizations as assigned by the Communist Party and State.

* Voting by show of hands (using party member cards to vote) is implemented in cases:

- Electing administrative bodies and assisting congress or meeting (the congress presidium, secretary group, congress secretary, meeting chairperson, delegate eligibility verification committee, vote-counting committee).

- Approving the number and list of candidates.
