Newest regulations on statistics, inspections of national defense and security land in Vietnam

According to Article 14 of Circular 08/2024/BTNMT, regulations on statistics and inspections of national defense and security land are as follows:

- The statistics and inspections of national defense and security land shall be presided over by the Ministry of National Defense and the Ministry of Public Security, in cooperation with the People's Committees at the provincial level.

- The People's Committees at the provincial level shall direct and guide subordinate People's Committees in collaborating with the Ministry of National Defense and the Ministry of Public Security to review and unify the locations and areas of national defense and security land in the locality.

- The statistics and inspections of national defense and security land shall be according to the land types specified in point c, clause 3, Article 9 of the Land Law 2024; clause 3, Article 5 of Decree 102/2024/ND-CP and shall be aggregated into the form specified in point e, clause 1, Article 5 of Circular 08/2024/BTNMT.

- The results of statistics and inspections of national defense and security land include reports and statistical forms as specified in point e, clause 1, Article 5 of Circular 08/2024/BTNMT.

- The Ministry of National Defense and the Ministry of Public Security shall send the results of the statistics and inspections of national defense and security land nationwide to the Ministry of Natural Resources and Environment before March 31 of the following year for land statistics results; before June 30 of the following year for land inspections results.

Regulations on topical land inspections in Vietnam

- A topical land inspections is a deep inspections of one or several land types specified in Article 9 of the Land Law 2024; Articles 4, 5, and 6 of Decree 102/2024/ND-CP; types of land users specified in clause 3, Article 4 of Circular 08/2024/BTNMT; and types of land management entities specified in clause 4, Article 4 of Circular 08/2024/BTNMT and other related contents as required by state land management in each period.

- The contents and activities of the topical land inspections are implemented according to the decision of the Minister of Natural Resources and Environment and the decision of the Chairman of the People's Committee at the provincial level.

- Based on the decision of the Minister of Natural Resources and Environment on the topical land inspections, the unit assigned to implement the specialized inspections is responsible for drafting and submitting to the Minister of Natural Resources and Environment the guidelines on criteria, forms, plans, procedures for implementation, and submission of the topical land inspections results.

- Based on the decision of the Chairman of the People's Committee at the provincial level on the topical land inspections, the unit assigned to implement the topical land inspections is responsible for drafting and submitting to the Chairman of the People's Committee at the provincial level the guidelines on criteria, forms, plans, procedures for implementation, and submission of the topical land inspections results.

Regulations on nationwide land inspections in Vietnam

- Preparatory work:

+ Draft directive documents for the People's Committees at the provincial level on implementing the land inspections;

+ Draft plans for implementing the land inspections and related guidance materials (if any);

+ Organize specialized training for the People's Committees at the provincial level and relevant agencies;

+ Collect relevant records, documents, maps, data within the land inspections period, national land use planning and plans; land inspections results of the previous period, annual land statistics during the national land inspections period, and other related materials.

- Guide, inspect, and expedite the implementation of the national land inspections.

- Receive the results of the inspections of national defense and security land from the Ministry of National Defense and the Ministry of Public Security; receive the land inspections results from the provincial level and direct corrections, complete data, and report land inspections results (if any).

- Process and aggregate national land inspections data; compile forms specified in points a, b, c, d, and dd, clause 1, Article 5 of Circular 08/2024/BTNMT and draft explanatory reports on current land use status as specified in clause 6, Article 10 of Circular 08/2024/BTNMT.

- Prepare land use status maps and develop explanatory reports on national land use status maps as specified in Articles 16, 17, 18, and 19 of Circular 08/2024/BTNMT.

- Develop a report on the nationwide land inspections results with main contents:

+ Situation of the organization and implementation of the national land inspections;

+ Analyze and assess the current land use status; analyze the reasons for land use changes between the land inspections year and data from the two most recent land inspections periods; report inconsistencies in administrative boundary lines at the provincial level during the land inspections period (if any);

+ Propose and recommend measures to improve the efficiency of land management and use.

- Inspect and accept national land inspections results.

- Complete and report to the Prime Minister of Vietnam on the national land inspections results.

- Print, reproduce, and publish the land inspections results as specified in clause 4 and point c, clause 5, Article 23 of Circular 08/2024/BTNMT.
