On July 29, 2024, the Government of Vietnam issued Decree 101/2024/ND-CP regulating basic land investigation; registration, issuance of certificates of land use rights, ownership of assets attached to land, and the Land Information System.

Newest regulations on procedures for appraisal, approval, and announcement of results for land conservation and restoration in Vietnam

Article 13 of Decree 101/2024/ND-CP stipulates the procedures for appraisal, approval, and announcement of results for land conservation and restoration in Vietnam as follows:

- Procedures for appraisal, approval, and announcement of results for land conservation and restoration in Vietnam for severely degraded inter-regional, inter-provincial lands.

+ The assigned agency submits the results of Land conservation and restoration for severely degraded inter-regional, inter-provincial lands to the Ministry of Natural Resources and Environment for appraisal; the appraisal dossier complies with the provisions of Clause 1, Article 16 of Decree 101/2024/ND-CP;

+ The Ministry of Natural Resources and Environment organizes the appraisal of the results of Land conservation and restoration for severely degraded inter-regional, inter-provincial lands;

+ After completing the application dossier for the results of Land conservation and restoration for severely degraded inter-regional, inter-provincial lands, the assigned agency submits it to the Ministry of Natural Resources and Environment for approval; the approval dossier complies with the provisions of Clause 2, Article 16 of Decree 101/2024/ND-CP;

+ The Ministry of Natural Resources and Environment approves and announces the results of Land conservation and restoration for severely degraded inter-regional, inter-provincial lands; the announcement dossier complies with the provisions of Clause 3, Article 16 of Decree 101/2024/ND-CP.

- Procedures for appraisal, approval of results for Land conservation and restoration for areas severely contaminated are carried out according to the provisions of environmental law.

- Procedures for appraisal, approval, and announcement of results for provincial-level Land conservation and restoration.

+ The provincial land management agency submits the results of provincial-level Land conservation and restoration to the Provincial People's Committee for appraisal; the appraisal dossier complies with the provisions of Clause 1, Article 16 of Decree 101/2024/ND-CP;

+ The Provincial People's Committee organizes the appraisal of the results of provincial-level Land conservation and restoration;

+ After completing the application dossier for the results of provincial-level Land conservation and restoration, the provincial land management agency submits it to the Provincial People's Committee for approval; the approval dossier complies with the provisions of Clause 2, Article 16 of Decree 101/2024/ND-CP;

+ The Provincial People's Committee approves and announces the results of provincial-level Land conservation and restoration; the announcement dossier complies with the provisions of Clause 3, Article 16 of Decree 101/2024/ND-CP.

Guidance for organizing the implementation of land conservation and restoration in Vietnam

According to Article 12 of Decree 101/2024/ND-CP, the guidance for organizing the implementation of land conservation and restoration in Vietnam is as follows:

- Develop and approve tasks for Land conservation and restoration.

+ Collect and process information and documents to serve the development of tasks for Land conservation and restoration;

+ Determine the objectives, content, and volume of Land conservation and restoration work;

+ Develop cost estimates according to work content and volume;

+ Submit to the competent authority for approval of tasks for Land conservation and restoration.

- Select implementing organizations and consultancy organizations for inspection and supervision.

- Implement plans for Land conservation and restoration according to the approved tasks.

- Prepare reports and create maps showing results of Land conservation and restoration.

- Complete Land conservation and restoration data and update it into the national land database.

More details can be found in Decree 101/2024/ND-CP, which comes into force in Vietnam from August 1, 2024.
