On July 01, 2024, the Chief Inspector of the Government of Vietnam issued Circular 07/2024/TT-TTCPon authority and subject matters of inspection of compliance with laws on inspection, citizen reception, complaints, whistleblowing, and anti-corruption measures in Vietnam

1. Newest regulations on matters of inspection of compliance with laws on anti-corruption in Vietnam

According to Article 13 of Circular 07/2024/TT-TTCP, the matters of inspection of compliance with laws on anti-corruption in Vietnam include:

- Content of State management on anti-corruption work

+ Development of legal documents, programs, and plans for anti-corruption work;

+ Propagation, dissemination, and education of anti-corruption law;

+ Implementation of information policies and anti-corruption reporting.

- Implementation of anti-corruption prevention regulations

+ Publicizing and transparency on the organization and operation of agencies, organizations, and units;

+ Formulation and implementation of standards, norms, and policies;

+ Implementation of the code of conduct for persons with positions and power;

+ Change of positions for persons with positions and power;

+ Implementation of administrative reforms, application of science and technology in management, and cashless payments.

- Implementation of regulations on asset and income control

+ Organize asset and income declarations; publicize asset and income declarations;

+ Manage, update, and follow fluctuations in assets and incomes of those obliged to declare;

+ Verify assets and incomes and publicize the verification conclusions on assets and incomes;

+ Protect, store, exploit, and provide information on asset and income control;

+ Handle individuals who fail to comply with the duty of honesty in asset and income declarations, explanation of the origin of increased assets and income; violations of deadlines for asset and income declarations and other regulations on asset and income control;

+ Build and manage the national database on asset and income control.

- Detection of corruption

+ Detect corruption through inspection and self-inspection activities;

+ Detect corruption through the resolution of complaints, denunciations, and reporting on corruption acts;

+ Detect corruption through inspection activities.

- Handling of corruption

+ Handle individuals committing acts of corruption;

+ Recover corrupt assets;

+ Handle other law violations on anti-corruption.

- Handling the responsibility of the head of agencies, organizations, and units in anti-corruption.

- Implement conclusions of inspection, audit reports, decisions on handling, and compliance with superior directives on anti-corruption work.

2. Matters of inspection of compliance with laws on Denunciation in Vietnam 

The matters of inspection of compliance with laws on denunciation in Vietnam are stipulated in Article 12 Circular 07/2024/TT-TTCP as follows:

- Content of State management on the settlement of denunciations

+ Counsel, develop, issue, and guide the implementation of denunciation regulations within competence (if any);

+ Monitor, summarize, and report on denunciations and their settlement results;

+ Establish, manage, exploit, use, and store dossiers of denunciation cases.

- Denunciation settlement activities

+ Receive and initially handle denunciation information;

+ Comply with regulations on the competence to settle denunciations;

+ Accept denunciations, perform procedures, verifying denunciation contents, and settle denunciations within the time limit;

+ Receive and handle information containing denunciation contents;

+ Issue conclusions on denunciation contents and handle conclusions from those settling denunciations;

+ Protect whistleblowers;

+ Publicize conclusions on denunciation contents and decisions on handling the accused violator.

More details can be found in Circular 07/2024/TT-TTCP which comes into force in Vietnam from August 15, 2024.
