On July 24, 2024, the Government of Vietnam issued Decree 95/2024/ND-CP detailing certain provisions of the Law on Housing 2023.

Newest regulations on content of the provincial housing development programs and plans in Vietnam

Article 9 of Decree 95/2024/ND-CP stipulates the content of the provincial housing development programs and plans in Vietnam as follows:

Content of the provincial housing development program in Vietnam includes:

- Basis for building the provincial housing development program as stipulated in Clause 1, Article 26 of the Law on Housing 2023;

- Assess the current status of each type of housing developed under projects specified in Clause 1, Article 31 of the Law on Housing 2023; individually constructed housing in terms of floor area; quality of detached houses, apartment buildings in urban and rural areas;

- Assess the current status of housing supported under national target programs on housing, public investment programs on housing (social housing, housing for the armed forces, official duty housing, resettlement housing, reconstruction of apartment buildings), and the housing real estate market situation in the locality;

- Analyze and assess the achievements of the indicators set in the previous program period; identify existing issues, difficulties, and their causes;

- Estimate the total additional floor area needed, the housing floor area needs of different groups eligible for social housing support, types of housing developed under projects, and the estimated land area for housing development projects (social housing projects; housing for the armed forces; resettlement housing; central government official duty housing, local government official duty housing, apartment building reconstruction projects);

- Identify overarching goals consistent with national housing development strategy goals and the local socio-economic development goals; identify specific goals according to the contents stipulated in Point b, Clause 2, Article 24 of the Law on Housing 2023, other goals based on local socio-economic development targets;

- Estimate the floor area of housing to be completed and put into use for each type of housing developed under projects; determine indicators for average housing floor area per person in urban and rural areas and the entire province, minimum housing floor area per person;

- Determine the state budget capital needs for housing development (if any) categorized by each planning period, specifying: central budget, local budget, and other sources of funds, prioritizing allocation for developing housing types under national target programs on housing.

If the housing needs in the program propose using public investment funds for housing development, during the program formulation, the provincial People's Committee will propose this funding source into the subsequent medium-term public investment plan in accordance with the law on public investment;

- Determine the areas proposed for housing development projects at the district level based on the areas oriented for residential or living unit development in the approved overall urban planning scheme and areas oriented for organizing residential space in the rural construction planning scheme;

- Other contents as stipulated in Clause 1, Article 27 of the Law on Housing 2023.

Content of the provincial housing development plan in Vietnam includes:

- Basis for creating the provincial housing development plan as stipulated in Clause 2, Article 26 of the Law on Housing 2023;

- Assess the current status of each type of housing developed under projects, achievements of the previous housing development plan period; identify existing issues, difficulties, and their causes;

- Estimate the floor area of various housing types to be completed and put into use, including commercial housing, social housing, housing for the armed forces, resettlement housing, official duty housing, housing under national target programs, housing constructed using public investment funds, and the number of housing units from housing construction projects expected to be completed in the plan period;

- Estimate the timeline for approving investment policies for projects, project implementation progress based on the current housing status, supply-demand balance, urbanization rate, and the ability to meet traffic and social infrastructure demands in the project area at the plan formulation time;

- Determine indicators for average housing floor area per person;

- The plan for reconstruction of apartment buildings (if any) includes the contents stipulated in Article 66 of the Law on Housing 2023;

- The capital needs determined in the plan include state budget and other funding sources for housing development;

If the program includes using public investment funds for housing development, the provincial People's Committee must clearly identify the public investment funds in the plan period, ensuring compliance with the approved local medium-term public investment plan (if any);

- Other contents as stipulated in Clause 2, Article 27 of the Law on Housing 2023.

More details can be found in Decree 95/2024/ND-CP. This decree is effective in Vietnam from August 1, 2024.
