On September 17, 2024, the Government of Vietnam issued Decree 116/2024/ND-CP amending and supplementing certain articles of Decree 138/2020/ND-CP on recruitment, use, and management of officials and Decree 06/2023/ND-CP on quality assessment of official entry exams in Vietnam.
Clause 5 Article 1 of Decree 116/2024/ND-CP has amended Article 18 of Decree 138/2020/ND-CP to determine the passing criteria for the official recruitment examination in Vietnam as follows:
(1) A candidate who passes the official recruitment examination must meet the following conditions:
(i) Achieve a score of at least 50 points in the second round. If the examination involves both written and interview components, the candidate must participate in both exams (written and interview) and achieve at least 50% of the maximum score on each exam;
(ii) Achieve a combined score of the second round and priority points (if any), ranked from highest to lowest within the recruitment targets of each job position, including positions commonly recruited for multiple agencies employing officials.
(2) If there are two or more candidates with equal scores according to point (ii) of (1) for the final position, the determination of the successful candidate will follow the priority order:
- The candidate with a higher score in the second round;- The candidate with a higher score in the written exam in the second round if the examination involves both written and interview components;- The candidate who passed the official entry quality assessment and was exempt from the first round;- The candidate with a higher score in the official entry quality assessment if both were exempt from the first round;- The candidate who answered more questions correctly in the general knowledge subject in the first round if both took the first round.
If it is still not possible to determine the successful candidate according to the priority order outlined in this clause, the head of the authority responsible for recruiting officials will decide.
(3) For job positions commonly recruited for multiple agencies using officials, the determination of the successful employing agency follows the priority selection in the candidates' application forms. If there are more successful candidates applying to work at a particular agency than the recruitment target of that agency, priority will be given to the candidate with a higher recruitment score. If two or more candidates have equal scores for the final target of that employing agency, the selection will follow the order of priority outlined in (2).
(4) Candidates who do not pass the official recruitment examination cannot retain their exam results for future recruitment examinations.
Clause 36 Article 1 of Decree 116/2024/ND-CP has amended Article 57 of Decree 138/2020/ND-CP on the authority and responsibility for transferring officials in Vietnam as follows:
(1) The authority to decide on transfers is in accordance with the regulations on the allocation of management responsibilities of the Communist Party and legal regulations.
(2) Implementation responsibilities:
- The authority deciding on transfers: Leadership, directing the preparation of transfer plans and arranging post-transfer assignments for officials; ensuring democratic, public, and transparent procedures; monitoring, inspecting, handling violations; managing, evaluating, and annually reviewing transferred officials; summarizing and assessing the transfer of leadership, management officials;
- The sending agency: Evaluating and assessing officials proposed for transfer; cooperating with relevant agencies in managing, monitoring, and maintaining regular communication with transferred officials; responsible for receiving and arranging or proposing job placements for post-transfer officials;
- The receiving agency: Complying strictly with transfer decisions of the competent authority; responsible for job allocation, creating a conducive environment for officials to maximize their capabilities and strengths; managing and evaluating transferred officials during their transfer period; cooperating with relevant agencies in proposing job placements for post-transfer officials;
- Transferring officials: Complying strictly with regulations, procedures, and assignments of the competent authority, sending, and receiving agency; cultivating and enhancing capabilities, striving to complete assigned tasks; subject to checks, supervision, periodic or ad-hoc reporting as required by the managing authority; maintaining contact with the sending agency;
- Advisory departments on organizational affairs and personnel of the agencies, units: Leading and cooperating with relevant agencies in advising, preparing transfer plans; assessing and proposing pre and post-transfer job placements; advising on summarizing and assessing the transfer process;
- Relevant agencies: Participating in appraisals, reviews for transfer personnel as per functions, responsibilities, and requirements of the competent authority; cooperating with advisory departments on organizational affairs and personnel in monitoring and expressing opinions on post-transfer job placements.
