Newest regulations on conditions for social housing support policies in Vietnam (Internet image)
On July 26, 2024, the Government of Vietnam issued Decree 100/2024/ND-CP detailing some provisions of the Housing Law 2023 regarding social housing development and management.
To be eligible for social housing support policies in Vietnam, the following conditions must be met:
(1) Conditions regarding housing
- In cases where the applicant does not own a house, this is determined when the subjects specified in Clause 1, Article 77 of the Housing Law 2023 and their spouse (if applicable) do not have their names on the Land Use Rights Certificate, property ownership associated with the land in the province, city under central authority where the social housing project is located at the time of submitting the application for purchasing or leasing social housing.
Within 07 days from the receipt of the request for confirmation of having a name on the Land Use Rights Certificate, property ownership associated with the land, the Office/Branch of District Land Registration Office in the province, city under central authority where the social housing project is located must certify the cases specified in this clause.
- In cases where the subjects specified in Clause 1, Article 77 of the Housing Law 2023 own a house but the average housing area per capita is less than 15 m^2^ per person. The average housing area per capita specified in this clause includes: the applicant, their spouse, parents (if any), and children (if any) registered for permanent residence at that house.
Within 07 days from the receipt of the request for confirmation of the average housing area per capita, the People's Committee of the commune must certify the cases specified in this clause.
(2) Conditions regarding income
- For subjects specified in Clauses 5, 6, and 8, Article 76 of the Housing Law 2023, income conditions must be ensured as follows:
+ If the applicant is single, the monthly actual income must not exceed 15 million VND, based on the salary table certified by the agency, unit, or enterprise where the applicant works.
If the applicant is married as per legal regulations, the total monthly actual income of the applicant and their spouse must not exceed 30 million VND, based on the salary table certified by the agency, unit, or enterprise where the applicant works.
+ The time to determine income conditions is within 01 year immediately preceding, calculated from the time the subjects specified in this clause submit the valid application to the investor to register for purchasing or leasing social housing.
- For subjects specified in Clause 5, Article 76 of the Housing Law 2023 without a labor contract, if single, the monthly actual income must not exceed 15 million VND; if married as per legal regulations, the total monthly actual income of the applicant and their spouse must not exceed 30 million VND. Within 07 days from the receipt of the request for confirmation, the People's Committee of the commune must certify the income conditions within 01 year immediately preceding, calculated from the time the subjects specified in this clause submit the valid application to the investor to register for purchasing or leasing social housing.
- For subjects specified in Clauses 2, 3, and 4 of Article 76 of the Housing Law 2023, they must belong to households classified as poor or near-poverty according to the poverty standards of the Government of Vietnam.
- For subjects specified in Clause 7, Article 76 of the Housing Law 2023, income conditions will be applied according to Article 67 of Decree 100/2024/ND-CP.
