On October 18, 2024, the Minister of Home Affairs issued Circular 11/2024/TT-BNV regulating the establishment and management of administrative boundary records in Vietnam.

1. Newest guidance on appraisal and acceptance of the administrative boundary records in Vietnam

According to the regulations in Article 4 of Circular 11/2024/TT-BNV, the appraisal and acceptance of administrative boundary records are conducted as follows:

- Examine and review administrative boundary records

+ Provincial People's Committees request in writing for the Ministry of Natural Resources and Environment of Vietnam to examine and review the administrative boundary records of the locality in accordance with legal regulations on techniques for determining administrative boundary lines, marking administrative boundary markers, and establishing administrative boundary records at all levels.

+ Based on the examination and review results of the Ministry of Natural Resources and Environment of Vietnam, the provincial People's Committees complete the dossier and submit it to the Ministry of Home Affairs of for appraisal and acceptance.

- Documents required for appraisal and acceptance include:

+ Written request from the Provincial People's Committee.

+ Report on the results of establishing administrative boundary records.

+ administrative boundary records in paper form (set number 01) and in digital form.

+ Copy of the Approval Decision accompanying the design - technical estimate for creating administrative boundary records.

+ Copy of inspection and acceptance records from the Provincial People's Committee, the investor's level, and the contractor unit (if any).

+ Copy of minutes and documents determining the administrative boundary line in the field.

+ Document from the Ministry of Natural Resources and Environment of Vietnam on the results of technical examination and review for determining administrative boundary lines, marking administrative boundary markers, and establishing administrative boundary records at all levels.

+ Results of updating the national border line on administrative boundary records (if any).

- The appraisal council for administrative boundary records comprises representatives from the Ministries of Home Affairs, Natural Resources and Environment, Defense, and Foreign Affairs.

- Appraisal content

+ Procedures and results of establishing administrative boundary records.

+ Legal value of the various documents and administrative boundary records.

+ Authority and responsibility of relevant agencies, organizations, and individuals in managing administrative boundaries and establishing administrative boundary records.

- Acceptance of the quantity and quality of administrative boundary records: Based on the voting results of the Appraisal Council, the Minister of Home Affairs considers and decides on the acceptance of the quantity and quality of administrative boundary records at various levels of localities.

2. Funds for compiling and managing administrative boundary records in Vietnam

Funds for compiling and managing administrative boundary records in Vietnam are regulated in Article 6 of Circular 11/2024/TT-BNV as follows:

- Funds for compiling and managing administrative boundary records for the part under the responsibility of local sources are ensured by local budgets, and the part under the responsibility of central ministries and agencies is ensured by the central budget.

- Establishment, approval, and finalization of the funds for compiling and managing administrative boundary records are carried out according to legal regulations on surveying and mapping, archiving, dossier management, and other related regulations.

More details can be found in Circular 11/2024/TT-BNV, which comes into force in Vietnam from October 18, 2024.
