New Regulations on the Organizational Structure of Agencies under the Government of Vietnam

This is a notable content regulated in Decree 47/2019/ND-CP amending and supplementing a number of articles of Decree 10/2016/ND-CP regulating agencies under the Government of Vietnam.

Clause 2, Article 1 of Decree 47/2019/ND-CP amends and supplements the provisions on the organizational structure of agencies under the Government of Vietnam as stipulated in Article 4 of Decree 10/2016/ND-CP. To be specific, the new organizational structure of the agencies under the Government of Vietnam is as follows:

The organizational structure includes: Departments; Offices; Subordinate professional organizations (if any).

Specifically:

- Department operates under the head’s policies and does not have its own seal. A department is only established when the workload requires the arrangement of 15 officials and public employees or more.- Office has its own seal.- Departments and Offices can establish units or equivalent organizations (hereinafter referred to as units). The number of units under Departments and Offices is specified in the decree stipulating the functions, tasks, powers, and organizational structure of each agency under the Government of Vietnam.

In special cases, if the subordinate organization has a different name, the Government of Vietnam will consider and decide appropriately in accordance with the functions and tasks of each agency under the Government of Vietnam.

The criteria for establishing units under Departments and Offices are stipulated in Decree 47/2019/ND-CP as follows:

- The work or field handled by the unit must encompass various tasks and have its own management process as required by the management subjects.- The workload requires the arrangement of 07 public employees or more.

For agencies under the Government of Vietnam that ensure regular and investment expenditure, operating under the enterprise mechanism, the minimum number of unit staff includes public employees and professional personnel under the self-control mechanism.

The number of deputy heads of units under Departments and Offices: Units with 07 to 09 public employees are allocated 01 Deputy Head, units with 10 public employees or more are allocated no more than 02 Deputy Heads.
