This is the prominent content of Circular 05/2018/TT-BXD guiding the export of minerals for use as construction materials (VLXD) issued by the Minister of Construction.
Circular 05 no longer details the export dossier components for minerals used as construction materials as currently specified in Article 5 Circular 04/2012/TT-BXD dated September 20, 2012.
Instead, the dossier for exporting minerals used as construction materials will apply according to customs and foreign trade management laws to unify with current foreign trade laws.
Additionally, the List, specifications, and technical criteria for minerals used as construction materials for export in Appendix I issued with this Circular also exhibit many differences compared to the regulations in Circular 04/2012/TT-BXD, for example:
- Silic white sand used as raw materials for manufacturing construction materials, according to the new regulations, must have a grain size ≤ 1.0 mm;
- Adding specifications and technical standards for fine or ultra-fine quartz sand powder, block stone, and construction stone...
This Circular is effective from August 15, 2018, and replaces Circular No. 04/2012/TT-BXD dated September 20, 2012, of the Minister of Construction, guiding the export of minerals used as construction materials.
The Ministry of Construction is responsible for implementing, guiding, and monitoring the execution of this Circular; they will also cooperate with relevant Ministries and sectors to organize periodic or ad hoc inspections regarding compliance with the law in the export of minerals used as construction materials in localities.
The provincial People's Committee is responsible for directing the relevant authorities to check periodically or unexpectedly the export of minerals used as construction materials following the law.
Exporting enterprises must prepare annual periodic reports (or ad hoc when requested by competent authorities) and send them to the provincial People's Committee (where the enterprise operates exports) in the form prescribed in Appendix II of this Circular before January 15 every year; the provincial People's Committee prepares reports to send to the Ministry of Construction before January 30 every year to compile reports to the Prime Minister of the Government of Vietnam.
If there are any obstacles during implementation, Ministries, sectors, localities, organizations, and individuals should promptly reflect them to the Ministry of Construction for review and resolution.
