New Regulations on the Conditions for Establishing New Hamlets and New Residential Groups

Circular 09/2017/TT-BNV has been issued by the Ministry of Home Affairs to amend and supplement Circular 04/2012/TT-BNV guiding the organization and activities of villages and residential groups.

According to the amendments in Circular 09, the establishment of new villages and new residential groups must ensure the following conditions:

Scale of households:

- For villages: In the Northern plains, Central regions, and Central Highlands, there must be 400 or more households; in the Southern region, there must be 500 or more households; in mountainous and island regions, there must be 200 or more households;- For residential groups: In the plains, there must be 500 or more households; in mountainous and island regions, there must be 300 or more households.

Other conditions:

- Villages and residential groups need to have essential socio-economic infrastructure that is suitable to the actual conditions of the locality to serve community activities and ensure the stable life of the people.

Additionally, for special cases, the conditions for establishing new villages and new residential groups will have specific differences, specifically:

- In border areas, isolated islands far from the mainland, the conditions and scale of households can be lower than the general regulations stated above.- For villages and residential groups that have long existed due to cultivation, settlement, or free migration, the conditions, processes, procedures, and documents are implemented according to the provisions for the establishment and dissolution of villages and residential groups; if the scale is not sufficient, the combination of residential clusters is carried out.
