New regulations on tasks and powers of training and retraining schools in Vietnam (Internet image)

On December 12, 2022, the Government of Vietnam issued Decree 103/2022/ND-CP regulating state agencies, political organizations, socio-political organizations, and the people's armed forces.

According to Decree 103/2022/ND-CP, the tasks and powers of the training and retraining schools have been expanded in many areas, as follows:

Tasks and powers of training and retraining schools in Vietnam

In Article 3 of Decree 103/2022/ND-CP, the tasks and powers of training and retraining schools are specified as follows:

(1) The school provides training and retraining to perform its duties and powers in accordance with the Party's regulations; and the provisions of the law applicable to public non-business units and units of the people's armed forces on organizational management, staffing, finance, assets, and the duties and powers specified from (2) to (8) within the scope of assigned functions.

The specific tasks and powers of the training and retraining school are specified in the regulations on the organization and operation of the school, approved and promulgated by the direct management agency.

(2) Regarding the training and retraining of cadres, civil servants, and public employees

- Training and retraining schools of state agencies, political organizations, and socio-political organizations performing the task of training and retraining cadres according to the Party's regulations and the law on training and retraining cadres, civil servants, and public employees;

- Training and retraining schools of the people's armed forces have the task of training and retraining officers, non-commissioned officers, professional soldiers, and defense workers; retraining leadership and management cadres on defense and security tasks and knowledge.

(3) Regarding training at higher education, vocational education, and other educational levels

- Training and retraining schools that are permitted by competent state agencies to provide training at higher education levels shall conduct training activities and ensure the quality of higher education according to the regulations for higher education institutions in Decree 103/2022/ND-CP.

- Training and retraining schools that are permitted by competent state agencies to conduct vocational education activities shall conduct training activities and ensure the quality of vocational education under the same regulations as for vocational education institutions and this Decree;

- Training and retraining schools that are permitted by competent state agencies to conduct educational activities at each educational level shall carry out educational activities and ensure quality under the same regulations as for educational institutions at that level and in Decree 103/2022/ND-CP;

- The training at the levels of higher education and vocational education must serve the human resource development needs of the sector and field in line with the Party's guidelines, the State's investment capacity, and society's ability to mobilize resources.

(4) Regarding scientific and technological activities

- Performing tasks and exercising powers related to scientific and technological activities in accordance with the law on science and technology;

- Training and retraining schools that provide training at higher education and vocational education levels shall perform tasks and exercise powers related to scientific and technological activities according to the provisions of law for higher education and vocational education institutions.

(5) Regarding education quality assurance conditions

- Recruiting, managing, employing, building, training, and retraining a contingent of teachers and educational administrators to meet the requirements in terms of quantity, structure, and standards according to the provisions of law for each educational activity;

- Mobilizing, managing, and using resources; building and strengthening facilities; investing in equipment, libraries, and information technology to meet training and retraining requirements.

(6) On management and support for learners

- Managing learners, ensuring the legitimate rights and interests of learners, and ensuring a pedagogical environment for educational activities;

- Implementing social policies for beneficiaries of social policies—people in ethnic minority areas, areas with extremely difficult socio-economic conditions.

(7) About notices, reports, and accountability

- Implementing the regime of reporting, publicizing information, connecting, and updating industry data as prescribed for each educational activity;

- Carrying out self-assessment of quality and accreditation in accordance with regulations on training programs of higher education and vocational education;

- Subject to inspection and review by the state management agency in the field of education, relevant ministries and branches, and the People's Committee of the province where the training and retraining school is located.
or organize training and retraining activities as prescribed.

(8) Perform other tasks assigned by competent authorities in accordance with the Party's regulations and relevant laws.

Tasks and rights of learners at training and retraining schools in Vietnam (New regulations)

According to Clause 1, Article 7 of Decree 103/2022/ND-CP, learners at training and retraining schools have the following duties and powers:

- To study, research, and practice according to regulations;

- To respect teachers, managers, officials, and employees of the training and fostering school;

- To be respected and treated equally, without discrimination on gender, ethnicity, religion, or origin; to be provided with sufficient information on learning and training;

- To be guaranteed conditions for studying, participating in science and technology activities, and other activities of the training and fostering school;

- To contribute ideas, participate in the management and supervision of education, training, and retraining activities, and establish conditions for ensuring the quality of education, training, and retraining activities;

- Other duties and powers as prescribed for learners The Law on Education 2019, the Law on Higher Education 2012 (amended 2018), the Law on Vocational Education 2014, and relevant regulations of law.

More details can be found in Decree 103/2022/ND-CP, which takes effect from February 1, 2023, and replaces Decree 125/2011/ND-CP.
