The Ministry of Home Affairs (Hanoi, Vietnam) has issued Circular 04/2024/TT-BNV providing guidance on the determination of the grade ratio of officials effective in Vietnam from August 15, 2024

On June 27, 2024, the Minister of Home Affairs (Hanoi, Vietnam) issued Circular 04/2024/TT-BNV amending Circular 13/2022/TT-BNV guiding the determination of the composition of official ranks.

New Regulations on grade ratio of officials effective in Vietnam from August 15, 2024

The grade ratio of officials from August 15, 2024, will be regulated by the Ministry of Home Affairs as follows:

(1) Grade ratio of officials for agencies, organizations, and units within and under the ministry, equivalent agencies

- For department-level organizations and equivalents within and under the ministry, equivalent agencies:

+ Senior specialist rank and equivalent: Maximum 40%;+ Principal specialist rank and equivalent: Maximum 40%;+ Specialist rank and equivalent, subordinates and equivalents, staff and equivalents: The remaining percentage (%) of ranks.

- For organizations within and under the general department:

+ For department-level organizations and equivalents within the general department:

- Senior specialist rank and equivalent: Maximum 30%;- Principal specialist rank and equivalent: Maximum 50%;- Specialist rank and equivalent, subordinates and equivalents, staff and equivalents: The remaining percentage (%) of ranks.

+ For organizations under the general department organized locally following vertical sectors:

- Principal specialist rank and equivalent: Maximum 40%;- Specialist rank and equivalent, subordinates and equivalents, staff and equivalents: The remaining percentage (%) of ranks.

(2) Grade ratio of officials for professional agencies and administrative organizations under the People's Committees at the provincial level

- For professional agencies and administrative organizations under the direct-run city People's Committee:

+ Principal specialist rank and equivalent: Maximum 50%;+ Specialist rank and equivalent, subordinates and equivalents, staff and equivalents: The remaining percentage (%) of ranks.

- For professional agencies and administrative organizations under the direct provincial People's Committee:

+ Principal specialist rank and equivalent: Maximum 40%;+ Specialist rank and equivalent, subordinates and equivalents, staff and equivalents: The remaining percentage (%) of ranks.

(3) Grade ratio of officials for professional agencies and administrative organizations under the People's Committees at the district level

Officials in professional agencies and administrative organizations under the district-level People's Committee must hold ranks of specialist and equivalent, subordinates and equivalents, staff and equivalents as appropriate to the standards and conditions of their job positions.

(4) Grade ratio of officials for other agencies, organizations

For agencies and organizations established under the regulations of the Communist Party, law, and assigned official quotas by competent authority but not covered by (1), (2), and (3), the head of the official management agency shall decide the application of the grade ratio of officials specified in (1), (2), and (3) in accordance with the functions, tasks, and scale of activities of the official-using agency.

Procedure for Determining structure and grades of officials effective in Vietnam from August 15, 2024

Specifically, Article 3 of Circular 13/2022/TT-BNV (amended at Circular 04/2024/TT-BNV) provides the procedure for determining the structure and grades of officials starting from August 15, 2024, as follows:

- The head of the official-using agency, based on Clause 1 of Article 2 of Circular 13/2022/TT-BNV and the list of job positions and the number of official quotas assigned to each job position in the agency or organization, to determine the percentage (%) of officials holding official ranks in the agency or organization, reports to the competent authority for approval.- The head of the official management agency approves the structure and grades of officials suitable to the complexity of the work by job position, nature, characteristics, and scale of activities of the official-using agency.- The personnel organization department of the agency, organization, or unit is responsible for advising and assisting the head in determining the number of official ranks and the structure and grades of officials of the agency, organization, or unit to submit to the competent authority for consideration and decision.
