New Regulations on Dossiers and Procedures for Extending Land Leases at Airports and Airfields

Circular 51/2018/TT-BGTVT has been issued by the Ministry of Transport to amend and supplement a number of articles of Circular 17/2016/TT-BGTVT detailing the management and operation of airports and airfields.

The application and procedures for extending land lease at airports, aerodromes have been amended and supplemented as follows by Circular 51:

1. At least 06 months before the lease term expires, organizations or individuals using the land should submit 01 set of documents either directly, via postal system, or by other appropriate means to the Airport Authority. The documents include:

- Application for an extension of the land lease term;- A copy from the original book or the copy and present the original for comparison or a certified copy (in case of direct submission), a certified copy (in case of submission by postal service) of the land lease decision, land lease contract, and the proof of having completed the financial obligations regarding the land according to the law of the most recent year;- Document from the competent authority regarding the adjustment of the investment project in cases where there is a change in the project’s operational duration (if any);- Document from the competent authority about the extension of the investment project duration.

2. In case the documents are incomplete or invalid, within 03 working days from the date of receipt, the Airport Authority shall notify and guide the applicant to supplement and complete the documents as per regulations.

3. Within 05 working days from the date of receipt of the complete documents, the Airport Authority shall issue a decision to extend the land lease; send the lease extension decision and the application for land lease of the organization or individual to the competent local authority to request issuance of the land lease rate as per regulations.

4. Within 03 working days from the receipt of the land lease rate, the Airport Authority shall sign the land lease contract.

5. Within 05 working days from the date of the land lease extension decision, the Airport Authority shall be responsible for sending the lease extension decision to the Civil Aviation Authority of Vietnam and the Land Registration Office where the land is located for updating and adjusting the cadastral records and land database.
