New Regulations on Changes to Professional Titles for Public Employees from 2019

Decree 161/2018/ND-CP amending and supplementing certain regulations on recruitment of officials and public employees, promotion of officials, and rank advancement of public employees officially took effect on January 15, 2019. This Decree has amended and supplemented regulations on changing job titles for public employees.

To be specific, according to the regulations at Clause 13, Article 2 of Decree 161/2018/ND-CP amending and supplementing Article 29 of Decree 29/2012/ND-CP, the change of professional title for public employees is carried out as follows:

- When transferring from one professional title to another within the same rank, the transfer must be conducted through the examination of professional titles;

- When promoting from a lower rank to a higher rank within the same industry or field, it must be conducted through examination or evaluation for professional title promotion. (The previous regulation in Decree 24 required that when promoting from a lower rank to the next higher rank within the same industry, it must be conducted through examination or evaluation for professional title promotion).

Thus, according to the new regulation in Decree 161, from January 15, 2019, when promoting from a lower rank to a higher rank within the same industry or field, regardless of whether the rank is adjacent or not, it must be conducted through examination or evaluation for professional title promotion.

At the same time, according to Decree 161, also from January 15, 2019, the agency or unit assigning public employees to take the examination or evaluation for professional title promotion must be responsible before the law for the standards and conditions of the public employees assigned to participate in the examination or evaluation for professional title promotion; and must keep and manage the registration documents of the participants as per legal regulations.
