New regulation on examination of quality of goods circulated on the market of Vietnam

The Government of Vietnam issued Decree No. 74/2018/NĐ-CP providing amendments and supplements to a number of articles of Decree No. 132/2008/ND-CP dated December 31, 2008 detailing the implementation of a number of articles of the Law on Products and Goods Quality.

According to Decree No. 74/2018/NĐ-CP of Vietnam’s Government, regulations on examination of quality of goods circulated on the market are amended as follows:

1. Product and goods quality examination agencies shall work out methods for collecting information on and analyzing unconformable contents, goods failing to satisfy quality standards and the situation of goods quality on the market in order to make annual examination plans, estimate examination budgets and identify specific goods subject to examination.

2. Depending on the type of inspection which may be carried out according to the inspection plan approved by competent authorities, on an unscheduled manner or under the regulatory authority’s direction, the inspection authority shall conduct an inspection of quality of goods currently in free circulation as follows:

- The inspection of compliance with Law on Quality of Products and Goods;

- After checking these requirements, if there is any sign of impairment of quality, the inspecting agency collects and tests samples at the conformity assessment body as prescribed by the law in order to check the conformity of the goods with the relevant national technical regulations or applied standards.
