NEW: Penalties for Violations of Alcohol and Beer Advertising Regulations

NEW: Penalty levels for violations of alcohol and beer advertising regulations (Illustrative image)

To be specific, Article 33 of Decree 117/2020/ND-CP stipulates the acts of violating alcohol and beer advertising regulations as follows:

1. A fine ranging from 15,000,000 VND to 20,000,000 VND for the act of using persons under the age of 18 directly participating in alcohol and beer advertising.

2. A fine ranging from 20,000,000 VND to 30,000,000 VND for one of the following acts of advertising alcohol with an alcohol content of less than 15 degrees and advertising beer:

- Containing information or images that encourage drinking alcohol or beer; information with content or images that show alcohol or beer as promoting maturity, success, friendliness, attractiveness regarding gender; targeting children, students, young people, pregnant women;- Using items, images, symbols, music, characters in movies, product brands for children, students; using images of persons under the age of 18 in alcohol and beer advertising;- Advertising at events, on advertising vehicles, products for persons under the age of 18, students, young people, pregnant women;- Advertising on transportation vehicles;- Advertising on radio or television right before, during, and immediately after children's programs; during the period from 6:00 PM to 9:00 PM daily, except as permitted by law;- Advertising on outdoor advertising media that violate size regulations, distance placement from educational institutions, facilities, areas for care, nurturing, entertainment for persons under the age of 18 as prescribed by law;- Advertising without warnings to prevent alcohol and beer harm as prescribed by law;- Advertising on electronic newspapers, websites, electronic media, terminal devices, and other telecommunications devices without having a filtering technology system, age verification software to prevent persons under the age of 18 from access, finding information about alcohol and beer.

3. A fine ranging from 30,000,000 VND to 40,000,000 VND for one of the following acts of advertising alcohol with an alcohol content from 5.5 degrees to less than 15 degrees and beer with an alcohol content from 5.5 degrees and above:

- Advertising in cultural programs, theater, cinema, sports activities;- Advertising on outdoor advertising media, except for the signboards of alcohol and beer business establishments.
