Chinhphu.vn) - Continuing the agenda of the 4th session, on the morning of November 10, the National Assembly voted to pass the Law on Implementation of Democracy at the Grassroots Level with 443/455 deputies voting in favor.
National Assembly passes the Law on Implementation of Grassroots Democracy
Before the approval, on behalf of the Standing Committee of the National Assembly, Chairman of the Law Committee of the National Assembly Hoang Thanh Tung presented the Explanation Report, acceptance, and revision of the draft Law on Implementation of Grassroots Democracy.
Regarding the adjustment of the implementation of grassroots democracy in organizations that employ labor, due to differing opinions, to ensure caution and to create high consensus and unity within the National Assembly, the Standing Committee of the National Assembly directed the Secretary General of the National Assembly to send ballots to National Assembly members to solicit their opinions on this matter.
The aggregated results showed that the opinions of the National Assembly members on the options were not highly convergent. Therefore, immediately after, the Standing Committee of the National Assembly held meetings and consulted with relevant agencies and organizations to study. Based on the opinions of the National Assembly members and the opinions of the agencies, the Standing Committee of the National Assembly directed the acceptance and revision of the draft Law in the direction that the implementation of grassroots democracy is adjusted by many legal documents. Among these, the Law on Implementation of Grassroots Democracy focuses on regulating the implementation of democracy in communes, wards, commune-level towns, state agencies, public service providers, and state-owned enterprises.
For enterprises and other organizations employing labor under labor contracts in the non-state sector, they will implement according to the general regulations in Chapter I of this Law; at the same time, they will reference the implementation according to labor law and other relevant legal provisions on the implementation of democracy at the workplace (Article 82).
Regarding the structure of the draft Law, after accepting and revising according to the opinions of the National Assembly members, the draft Law comprises 6 chapters and 91 articles, which is one article less than the draft Law submitted to the National Assembly at the 4th session.
Of these, Chapter IV of the draft Law on the implementation of democracy in labor-using organizations is structured into 2 sections. Section 1 specifies the implementation of democracy in state-owned enterprises, comprising 4 sub-sections. Section 2 comprises one article regulating the implementation of democracy in enterprises and other organizations employing labor under labor contracts in the non-state sector.
Regarding the principles of implementing grassroots democracy (Article 3) and the rights of citizens to benefit from the implementation of grassroots democracy (Article 7), the Standing Committee of the National Assembly accepted the opinions that suggested adding the principle "the implementation of democracy at labor-using organizations should not affect the production and business activities of the labor-using organizations"; adding the right of citizens to benefit from the results of implementing grassroots democracy regulations.
Regarding the opinions on the activities of the Community Investment Supervision Board, the Standing Committee of the National Assembly stated: The activities of the Community Investment Supervision Board mainly focus on monitoring and inspecting the compliance of investors with legal regulations on land boundaries and use, detailed planning of architectural options, construction, waste treatment, environmental protection; the implementation progress and status of programs and projects; and the public disclosure of information during the investment process… without delving into detailed and technical issues.
From there, identifying actions that infringe on the benefits of the community, negatively impact the living environment of the community, or cause waste and loss of state and community capital and assets.
Chairman of the Law Committee of the National Assembly Hoang Thanh Tung also reported and explained the contents of acceptance and revision of regulations on the implementation of democracy in agencies and units (Chapter III); on organizing the implementation of the law on grassroots democracy (Chapter V); and on the application of law (Article 92).
