MONRE: To strengthen review of projects and construction works that are behind schedule on land use in Vietnam

On October 13, 2022, the Minister of Natural Resources and Environment issued an Official Dispatch 6118/BTNMT-TCQLĐĐ on strengthening inspection and handling of projects and works that do not put land into use and are behind the progress of land use in Vietnam.

Specifically, following Directive 01/CT-TTg dated January 3, 2018, the Ministry of Natural Resources and Environment has issued documents directing localities to implement. However, the implementation of many localities is still not resolute, they have not fully implemented the prescribed contents, and they have not handled all violations according to their authority.

In order to accelerate the effective use of land for the socio-economic development of the locality and the whole country, avoiding land waste, the Ministry of Natural Resources and Environment recommends the following contents:

The Ministry of Natural Resources and Environment requests the People's Committees of provinces and centrally run cities to urgently direct and organize the implementation of the following activities:

- Review and prepare lists and management records for projects and works that have been allocated or leased land to implement the project without using land for 12 consecutive months or the progress of putting land into use is 24 months late, as prescribed in Point i, Clause 1, Article 64 of the Land Law 2013.

- Review and synthesize difficulties and problems; evaluate the causes (objective and subjective) of not putting land into use or slow land use progress; Focus on researching, removing difficulties, and speeding up the resolution of administrative procedures (investment, land, construction, etc.) to urge investors in projects to promptly invest and put land into use.

- Organize inspection and examination of all projects and works that do not put land into use or have slow land use progress; Strictly, thoroughly, and legally handle projects and work with violations; Resolutely recover land for projects and works whose investment projects have ended; the time limit for land use extension has expired, but the investment in putting the land into use has not yet been completed.

To synthesize and make a list of projects and work with violations in Vietnam

Specifically, the People's Committees of provinces and centrally run cities compile a list of projects and works with violations to post publicly on the electronic portal of the Provincial People's Committee and send information to post on the electronic information portal of the Ministry of Natural Resources and Environment and the General Department of Land Management.

Then send a summary and report on implementation results to the Ministry of Natural Resources and Environment before November 30 every year to summarize and report to the Prime Minister, according to the attached form.
