Minor Offenders in Vietnam shall conduct self-review every 3 months

On February 17, 2012, the Government of Vietnam issued Decree 10/2012/ND-CP providing detailed regulations on the implementation of judicial education measures at commune, ward, commune-level town for juvenile offenders in Vietnam.

Minor Offenders in Vietnam shall conduct self-review every 3 months (Internet image)

Article 15 of the Decree 10/2012/ND-CP stipulates the obligations of minors committing crimes subjected to educational measures at commune-level, ward, and commune-level town in Vietnam, as follows:

- Comply strictly with the policies and laws of the State, actively participate in labor and study, fully perform civic duties, and adhere to the rules and regulations of the local residence.

- Be subject to the supervision and education of the government, agencies, social organizations, schools, and the person directly assigned for supervision and education.

- Make a commitment to correct violations, strictly comply with the law, actively fulfill obligations of study, self-improvement, training, and participation in labor, and send it directly to the commune-level People's Committee, social organizations, and the school assigned for supervision and education, and must strictly observe the commitment.

- Submit a monthly written report to the person directly assigned for supervision, education, and assistance on the status of study, labor, training, self-improvement, results of correction of violations, and personal progress.

- Every three months, make a self-review report on the implementation of commitments and send it to the commune-level People's Committee, social organizations, and the school assigned for supervision and education. The self-review report must be supplemented with comments from the person directly assigned for supervision and education. For individuals under 16 years old, the self-review report must additionally include comments from the parents or legal guardians.

- In case the educated person is illiterate, the parents or legal guardians must write the commitment to correct violations, report, and self-review report as prescribed in clauses 3 and 4 of this Article.

- Attend and meet the requirements at the announcement session on the implementation of educational measures at commune, ward, and commune-level town. Be present and participate in the review session when summoned by the Chairperson of the commune-level People's Committee, the head of a social organization, the school principal, and the person assigned for supervision and education.

- In case of absence from the residence, adhere to all regulations in Article 10 of this Decree and obtain comments from the commune-level police where the educated individual temporarily stays to report to the commune-level People's Committee, social organizations, schools, and the person assigned for supervision and education.

Details can be found in Decree 10/2012/ND-CP, which comes into effect in Vietnam from April 10, 2012.
