Regarding this matter, LawNet would like to answer as follows:
On March 18, 2024, the Ministry of Industry and Trade of Vietnam issued urgent documents sent to the People's Committees of the provinces and centrally affiliated cities, the Departments of Industry and Trade of the provinces and cities, petroleum trading businesses, and petroleum distribution businesses regarding the implementation of regulations on e-invoices and providing e-invoice data as prescribed.
In Official Dispatch 1654/BCT-TTTN, the Ministry of Industry and Trade clearly states the implementation of the directive of the Prime Minister at Resolution 28/NQ-CP dated March 5, 2024, at the government’s regular meeting in February 2024, and the Conference for the implementation of monetary policy management tasks in 2024 on focusing on resolving difficulties for production and business, promoting growth, and stabilizing macroeconomic conditions dated March 14, 2024. The Ministry of Industry and Trade of Vietnam requests the People's Committees of the provinces and centrally affiliated cities to direct departments and sectors to prioritize resources to support petroleum businesses in implementing the regulations on issuing and recording e-invoices for retail petroleum business activities, especially in issuing e-invoices at petrol retail stores for customers for each sale and providing e-invoice data as prescribed.
At the same time, it is necessary to strengthen supervision, inspection, urging, and resolutely implementing the management and use of e-invoices for retail petroleum business activities according to the Prime Minister's directives in Official Telegram 1123/CD-TTg dated November 18, 2023, and Official Telegram 1284/CD-TTg dated December 1, 2023. Coordinate with the Ministry of Finance and the Ministry of Industry and Trade to direct functional forces to consider and handle petroleum businesses that do not comply with e-invoice regulations by March 31, 2024.
In Official Dispatch 1655/BCT-TTTN, the Ministry of Industry and Trade requests the Departments of Industry and Trade of the provinces and centrally affiliated cities to urge and supervise petroleum trading businesses in the locality:
(1) Comply with the legal provisions on petroleum trading;
(2) Issue e-invoices at petrol retail stores for customers for each sale and provide e-invoice data as prescribed. Additionally, closely monitor the supply-demand balance of petroleum products to ensure that no petrol retail store suspends sales causing local supply shortages.
In addition, the Ministry of Industry and Trade of Vietnam also sent Official Dispatch 1656/BCT-TTTN to petroleum trading businesses and petroleum distribution businesses. The dispatch clearly states that, based on the provisions of Clause 9, Article 1 of Decree 80/2023/ND-CP dated November 17, 2023, amending and supplementing several articles of Decree 95/2021/ND-CP dated November 1, 2021, and Decree 83/2014/ND-CP dated September 3, 2014, of the government on petroleum trading;
Implement Official Telegram 1123/CD-TTg dated November 18, 2023, on strengthening the management and use of e-invoices, contributing to promoting digital transformation, and Official Telegram 1284/CD-TTg dated December 1, 2023, on enhancing the management and use of e-invoices for petroleum business and retail activities;
Implement the Prime Minister's directive in Resolution 28/NQ-CP dated March 5, 2024, the Ministry of Industry and Trade requests petroleum businesses to seriously implement the following contents:
Firstly, comply with the legal provisions on petroleum trading;
Secondly, issue e-invoices for petroleum business and retail activities, especially in issuing e-invoices at petrol retail stores for customers for each sale at petrol retail stores and provide e-invoice data as prescribed.
The Ministry of Industry and Trade of notes that during the implementation process, if there are difficulties or obstacles, businesses are requested to report and seek guidance from relevant agencies and units.
