Ministry of Finance of Vietnam: Not all casinos are permitted to accept Vietnamese customers

The Ministry of Finance (Hanoi, Vietnam) has just released a statement clarifying the conditions that Vietnamese citizens need to meet in order to enter and play at casinos starting from December 1, 2017.

According to the Ministry of Finance, recently, some online newspapers have reported that Vietnamese people will be allowed to play in casinos. However, according to this Ministry, not every casino location is permitted to allow Vietnamese people to play, and not every Vietnamese person is allowed to enter and play in casinos.

To be specific: it will be "piloted to allow Vietnamese people to enter and play at casino business points within investment projects for comprehensive service, tourism, and entertainment complexes with casinos at locations complying with the regulations in this Decree and permitted by competent authorities."

The Decree also stipulates specific conditions for Vietnamese people to enter casinos, such as: must be at least 21 years old and have full civil capacity; have financial capability (a regular income of VND 10 million/month or more or subject to income tax from level 3 and above); must purchase a ticket to participate in the casino (entry ticket is VND 1 million/24 continuous hours/person or VND 25 million/month/person) and are not subject to a request from family members (father, foster father, mother, foster mother, wife, husband, biological children) asking the casino business to prohibit them from playing at the casino business point.

On October 5, 2017, the Ministry of Finance (Hanoi, Vietnam) issued Circular 102/2017/TT-BTC (which comes into force in Vietnam from December 1, 2017) guiding several provisions in Decree 03/2007/ND-CP, which includes guidelines on documents proving that Vietnamese people have sufficient financial capacity to participate in casino games, requiring one of the following documents:

“1. Documents proving taxable income from level 3 and above according to the Personal Income Tax Law: A certified copy of the personal income tax return that has been settled by the tax authorities or a confirmation of tax obligations from the tax authorities, proving the player has taxable income from level 3 and above according to the Personal Income Tax Law within 1 year before entering the casino.

2. Documents proving regular income of VND 10 million/month or more:

a) A certified copy confirming monthly income, monthly salary statements, or salary payment decisions from the player’s workplace, confirming within the last 3 months from the date of entry into the casino, showing a monthly income of VND 10 million or more;

b) A certified copy of the rental contract for houses or assets of the player, still valid according to the law, showing a total monthly rental income of VND 10 million or more;

c) A certified copy of the bank savings book, bank deposit account statement of the player with a term of 1 year or more and generating monthly interest of VND 10 million or more;

d) Other documents proving the player has a regular income of VND 10 million/month or more;

dd) In cases where the documents mentioned in points a, b, c, and d of this Clause do not prove the player’s income of VND 10 million/month, the player can present multiple documents simultaneously to prove a total regular income of VND 10 million/month or more.”

“Therefore, after the competent authorities decide on the specific pilot locations according to Decree 03/2017/ND-CP, Vietnamese people entering casinos must meet the conditions stipulated by law (age, civil capacity, identity, finance)” – the Ministry of Finance (Hanoi, Vietnam) clarified.
