Regarding this issue, LawNet would like to answer as follows:

On January 17, 2024, the Ministry of Culture, Sports, and Tourism issued Decision 142/QD-BVHTTDL on the Regulations for the reception of citizens by the Ministry.

Time and locations for reception of citizens in Vietnam

(1) Time for reception of citizens:

Reception of citizens is carried out during working hours at the designated location for reception of citizens by the Ministry of Culture, Sports, and Tourism.

- Regular reception of citizens is conducted during working hours on weekdays.

- Scheduled reception of citizens:

+ The Minister conducts a scheduled reception for citizens on the 15th of every month. (The Ministry's Office announces it in the weekly work schedule of the Ministry's leadership).

+ The Chief Inspector of the Ministry conducts the reception of citizens every Thursday.

+ Heads of agencies and units located outside the Ministry's headquarters determine the scheduled time for the reception of citizens based on the specific situation and conditions of their respective agencies and units.

- Unscheduled reception of citizens:

+ Unscheduled reception of citizens is conducted in the following cases:

(i) Serious and complex cases involving multiple agencies, organizations, units, or differing opinions of other agencies, organizations, or units;

(ii) Cases that, if not promptly directed and considered, may cause serious consequences or damage to state property, collective property, harm to people's lives, and affect national security, politics, social order, and safety.

+ The Minister, heads of agencies, and units under the Ministry are responsible for conducting unscheduled receptions of citizens and informing citizens of the reception time for implementation.

- The schedule for regular reception of citizens and scheduled reception of citizens is posted at the location for reception of citizens.

(2) Locations for the reception of citizens:

The locations for reception of citizens by the Ministry of Culture, Sports, and Tourism include the reception of citizens rooms and the locations for reception of citizens by agencies and units under the Ministry of Culture, Sports, and Tourism.

- The place of reception for citizens is located at the Ministry of Culture, Sports, and Tourism headquarters, 51-53 Ngo Quyen Street, Hang Bai Ward, Hoan Kiem District, Hanoi.

The Inspectorate of the Ministry is directly responsible for managing and regularly receiving citizens at the reception room.

- The location for the reception of citizens at agencies and units located outside the Ministry's headquarters. Agencies and units under the Ministry located outside the Ministry's headquarters must arrange the location for the reception of citizens of their respective agencies and units.

The location for the reception of citizens of agencies and units must be conveniently located, ensuring the necessary material conditions for citizens to present their complaints, accusations, recommendations, and feedback easily and conveniently.

- Clear regulations on the Rules for the reception of citizens and other information as specified in Clause 2 of Article 24 of the Law on the reception of citizens must be posted at the location for the reception of citizens. The Rules for the reception of citizens within the Ministry of Culture, Sports, and Tourism are issued by the Minister and implemented uniformly.

04 cases for refusing reception of citizens by the Ministry of Culture, Sports, and Tourism in Vietnam

According to Article 4 of the Regulations for the reception of citizens by the Ministry of Culture, Sports, and Tourism 2024, there are four cases for refusing reception of citizens:

(1) Individuals under the influence of intoxicating substances, individuals with mental illness, or other conditions that impair their cognitive abilities or ability to control their behavior;

(2) Individuals who threaten or offend the agency, organization, unit, the person receiving citizens, the person performing official duties, or violate the rules at the place for the reception of citizens;

(3) Individuals who file complaints or accusations about cases that have been properly resolved according to policies and laws, have been examined and reviewed by competent state authorities, notified in writing, and still intentionally prolong the complaints or accusations;

(4) Other cases as prescribed by law.

The person receiving citizens must explain the reason for refusing reception of citizens in the above cases and report to the person in charge of reception of citizens.

Note: In cases of refusing reception of citizens as prescribed, the head of the agency or unit under the Ministry issues a Notice of Refusal of reception of citizens. The notice is carried out according to Form No. 01 attached to the Regulations for the reception of citizens by the Ministry of Culture, Sports, and Tourism 2024.
