In Article 27 of Regulation 102-QD/TW, it is stipulated that disciplinary actions will be taken against Communist Party members who have a third child. However, there are exceptions where the Communist Party's Charter still allows members to have a third child.
To be specific: according to Point c Clause 10 Chapter III of Guideline 09-HD/UBKTTW for handling the discipline of Communist Party members, it is stipulated as follows:
c) The following cases do not violate population policy and family planning: - Couples having a third child if one or both belong to an ethnic group with a population of less than 10,000 people or belong to an ethnic group at risk of population decline (birth rate less than or equal to death rate) as officially announced by the Ministry of Planning and Investment. - Couples having their first birth, which results in triplets or more. - Couples who already have one biological child and have a second birth resulting in twins or more. - Couples having their third birth or more, if at the time of birth, they have only one living biological child, including biological children given up for adoption. - Couples having a third child if they already have two biological children, but one or both are disabled or suffer from a non-genetic life-threatening illness, confirmed by a provincial or central-level Medical Assessment Council. - Couples who have stepchildren (biological children): + Have one or two children if one partner already has stepchildren (biological children). + Have one or two children in a single birth, if both partners have stepchildren (biological children). This provision does not apply if the couple has had two or more joint children who are still alive. - Unmarried women who give birth to one or two children in a single birth. - Having a third child or more before January 19, 1989 (the effective date of Decision 162-HDBT, dated October 18, 1988, of the Council of Ministers "On some population policies and family planning"). |
Thus, if Communist Party members fall into one of the above cases, they will not be disciplined for having a third child. Everyone needs to thoroughly understand the provisions that the Communist Party Charter allows to apply appropriately to the actual situation.
