On February 27, 2018, the Ministry of Labor, War Invalids, and Social Affairs issued Circular 01/2018/TT-BLDTBXH, which specifically regulates the method for compiling statistics on the number of workers going to work abroad under contract for a fixed term during the year.
Accordingly, Circular 01 stipulates that workers going to work abroad under a contract are Vietnamese citizens residing in Vietnam, who meet the conditions as prescribed by Vietnamese law and the law of the receiving country, and go to work abroad under a contract sending the worker to work abroad or under an individual contract.
A contract sending the worker to work abroad is a written agreement between an enterprise, a professional organization, and the worker regarding the rights and obligations of the parties in sending the worker to work abroad in the following forms:
- A contract sending the worker to work abroad with a service enterprise that sends workers to work abroad, a professional organization permitted to send workers to work abroad;- A contract sending the worker to work abroad with an enterprise winning a contract, receiving a contract, or organization, individual investing abroad that sends workers to work abroad;- A contract sending the worker to work abroad in the form of an apprenticeship to improve skills with an enterprise that sends workers to work under the form of an apprenticeship to improve skills;
An individual contract is a direct written agreement between the worker and the foreign party regarding the worker going to work abroad.
At the same time, Circular 01 stipulates the main focus of grouping:
- Gender- Professional level- Profession- Market area.
Publication period: Year.
Additionally, the data source is regulated by Circular 01 to be taken from statistical reports of the Departments of Labor, Invalids and Social Affairs and units sending workers to work abroad under a contract.
The Department of Overseas Labor Management is the responsible agency for collection and consolidation.
