Member of the National Ethics Council does not include officials from the Ministry of Health

Currently, Biomedical Research Involving Human Participants is scientific research in the field of healthcare, in which humans are affected by interventions, observations, or other interactions due to participation in the research or can be identified through the collection, analysis, and use of data and biological materials in the healthcare field.

Circular 4/TT-BYT stipulates that the National Ethics Committee in Biomedical Research shall not include officials from the Ministry of Health. Additionally, the independence of the National Ethics Committee in Biomedical Research and the Institutional Ethics Committees in Biomedical Research (hereinafter referred to as the Ethics Committee) is regulated as follows:

- Members of the Ethics Committee shall not review research in which they, their spouse, biological father, adoptive father, biological mother, adoptive mother, biological child, adopted child, biological sibling, sibling-in-law, or spouse's family members have a conflict of interest.

- Members of the Ethics Committee shall not participate in supporting or implementing research that they have reviewed and approved through the Ethics Committee.

- Members of the Ethics Committee must include at least one health professional independent of the organization that established the Ethics Committee.

- The Ethics Committee shall not include the head of the organization that established the Ethics Committee, members from research funding organizations, or organizations conducting research reviewed by the Ethics Committee.
