Mechanism for organization and operation of overseas Vietnamese cultural centers

Recently, the Ministry of Culture, Sports, and Tourism of Vietnam issued Circular 10/2011/TT-BVHTTDL regulating the organization and operation of overseas Vietnamese cultural centers.

According to Circular 10/2011/TT-BVHTTDL, the mechanism for organization and operation of overseas Vietnamese cultural centers are regulated as follows:

1. Organizational structure and staffing of the overseas Vietnamese cultural center

- Depending on each location and foreign affairs requirements, each Center includes the following main titles:

- Director;

- One Deputy Director;

- One Chief of Office concurrently acting as Accountant;

- Two professional specialists in charge of cultural and artistic affairs, tourism promotion, sports activities, library, global information network (Internet), and information and communication work.

- The Director of the Center is appointed by the Minister of Culture, Sports, and Tourism of Vietnam and is recommended to the Ministry of Foreign Affairs for consideration for conferment of diplomatic rank according to legal regulations.

- The Director of the Center is responsible for developing the working regulations of the Center; organizing implementation after approval from the Department of Personnel and Organization, the Department of Financial Planning, and the Department of International Cooperation under the Ministry of Culture, Sports, and Tourism.

- The Director of the Center decides to hire laborers in the host country through employment contracts after obtaining written consent from the Minister and complying with the host country's laws. Salaries paid to laborers must align with the pricing level of the host country and within the allocated budget estimate. The Director of the Center determines the adjustment of salaries to ensure principles of cost-saving, efficiency, and reasonableness.

2. Operational mechanism and funding of the overseas Vietnamese cultural center

- The Center is under the direct professional management and operation of the Ministry of Culture, Sports, and Tourism and the foreign affairs guidance of the overseas Vietnamese diplomatic missions and consular offices in the host country.

- The Center adheres to policies on financial management, management, and use of state assets applicable to Vietnam representative offices located overseas under current Vietnamese laws and host country laws.

- The funding sources for the Center's operations include:

- Funds from the State budget for activities according to the assigned functions, tasks, and authorities;

- Fees and charges, other lawful revenues as stipulated by current laws.

3. Reporting regime of the overseas Vietnamese cultural center

- Periodic reports:

- Semi-annual work report submitted to the Ministry of Culture, Sports, and Tourism (via the Department of International Cooperation) before June 10 every year;

- Annual summary report submitted to the Ministry of Culture, Sports, and Tourism (via the Department of International Cooperation) before November 25 every year.

- Specialized reports as requested by competent authorities or for direction and guidance from higher levels.
