Measures for the Prevention and Combat of Smuggled and Counterfeit Tobacco in Accordance with Current Laws

To be specific, according to the provisions of Article 26 of the Law on Prevention and Control of Tobacco Harm 2012, measures to prevent and control smuggled and counterfeit tobacco include:

First, propagating, educating, and raising awareness for people not to participate in the trading, transportation, storage, and use of smuggled and counterfeit tobacco.

Second, organizing and ensuring sufficient human resources, funding, and means for the force against smuggled and counterfeit tobacco.

Third, periodically and regularly organizing inspections, checks, and handling of behaviors related to trading in smuggled and counterfeit tobacco.

Fourth, confiscating and destroying counterfeit tobacco; confiscating and destroying machinery and equipment used to produce counterfeit tobacco. The destruction must use methods that ensure environmental safety. The cost of destruction is borne by the violating individuals or organizations. If the violating individuals or organizations are not identified, the destruction costs are covered by the state budget.

Fifth, the handling of smuggled tobacco is carried out in accordance with the regulations of the Government of Vietnam.

Sixth, encouraging material and spiritual incentives for agencies, organizations, and individuals who have detected and denounced acts of trading in smuggled and counterfeit tobacco.

Seventh, coordinating at the provincial and national levels with countries sharing borders and related countries in the prevention and control of trading in smuggled and counterfeit tobacco.
