Measures for Remediation of Consequences in Administrative Sanctions in the Fisheries Sector

This is a notable content stipulated in Decree 42/2019/ND-CP on penalties for administrative violations in the field of fisheries.

In addition to the remedial measures stipulated in Clause 1, Article 28 of the Law on Handling Administrative Violations, administrative violations in the field of fisheries also apply the following remedial measures:

- Forced release of live aquatic species back into their habitat;- Forced transfer of dead aquatic species listed in the category of endangered, precious, and rare species to the competent authority for handling;- Forced release of additional endangered, precious, and rare aquatic species;- Forced restoration of the original state for functional subdivisions within marine protected areas, aquatic species habitats, sea areas, fish port areas, fish port water areas, and fish port structures;- Forced destruction or change of use of breeding aquatic species, aquatic species, aquatic products, aquatic feed, and aquaculture environmental treatment products;- Forced re-export of breeding aquatic species, aquatic species, aquatic feed, and imported aquaculture environmental treatment products;- Forced recycling of aquatic feed and aquaculture environmental treatment products;- ...
