Operators of motorcycles will be penalized if they do not conform to the regulations regarding the maximum number of passengers allowed on the motorcycle. So, what is the regulation on the maximum number of passengers a motorcycle can carry?
According to the provisions of Clause 1, Article 30 of the Road Traffic Law 2008, operators of two-wheeled motorbikes and mopeds are only allowed to carry one passenger, except in the following cases where they can carry up to two people:
- Transporting a patient to the emergency room;
- Escorting a person violating the law;
- Children under 14 years old.
Thus, the law only allows up to 2 people to be on a motorcycle, which means a motorcycle is allowed to carry 1 person, except in certain cases where it can carry up to 2 people. Other cases that exceed the allowed number of passengers as stipulated in Clause 1, Article 30 of the Road Traffic Law will be subject to administrative penalties.
Regarding the administrative fines for carrying more than the maximum number of passengers on a motorcycle, it is stipulated in Point b, Clause 4, Article 6 of Decree 46/2016/ND-CP, specifically:
**A fine of 300,000 – 400,000 VND is imposed if carrying 03 or more people on the vehicle, and the vehicle operator will also be deprived of the right to use the driving license for 1-3 months.
