Maximum Contract Duration for Public Employee is 3 Years, Signed Twice

This is a notable content stipulated in Decree 161/2018/ND-CP amending and supplementing some regulations on the recruitment of officials and public employees, promotion to higher official ranks, advancement of public employee grades, and implementation of contract policies for certain types of work in state administrative agencies and public service providers.

A public employee recruited into a public service provider must sign an initial fixed-term employment contract, and the duration of the contract is from 12 months to 36 months. The period for implementing probationary policies (if any) is stipulated in the fixed-term employment contract.

After the aforementioned employment period, based on the performance results and the unit's utilization needs, the head of the unit shall proceed according to one of the following options:

- Decide to continue signing a fixed-term employment contract with the public employee;

- Terminate the employment contract with the public employee.

If the public employee signs a second fixed-term employment contract, then after the expiration of the contract duration, the head of the public service provider shall consider either signing an indefinite-term employment contract or terminating the employment contract with the public employee.
