On July 01, 2024, the Inspector General of the Government of Vietnam issued Circular 07/2024/TT-TTCP on authority and subject matters of inspection of compliance with laws on inspection, citizen reception, complaints, whistleblowing, and anti-corruption measures in Vietnam.

Matters of inspection of compliance with laws on inspection in Vietnam from August 15, 2024

The matters of inspection of compliance with laws on inspection in Vietnam from August 15, 2024 from August 15, 2024, include:

- State management content on inspection

+ Consulting, developing, promulgating, and guiding the implementation of regulations on inspection organization and activities under authority (if any);

+ Implementing responsibilities of the heads of state management agencies, heads of agencies performing inspection functions as prescribed by the Law on Inspection 2022;

+ Implementing information and reporting policies;

+ Creating, managing, exploiting, using, and storing inspection records and other contents as prescribed by the law on inspection.

- Inspection activities

+ Organizing, developing, and promulgating inspection plans and implementing inspection plans;

+ Performing the duties and powers of the Decision Issuer, Head of Inspection Delegation, and other members of the Inspection Delegation during the inspection;

+ Exercising the authority to issue inspection decisions; developing and approving plans to conduct inspections; complying with the inspection time limits; procedures and processes of conducting an inspection; reporting inspection results; concluding inspections, publicizing inspection conclusions; handling inspection violations, and monitoring, urging, and checking the implementation of conclusions, recommendations, and decisions on inspection handling;

+ Supervising the activities of the Inspection Delegation, appraising the draft Inspection Conclusion;

+ Implementing the responsibilities of the heads of state management agencies at the same level in issuing documents to organize the implementation of inspection conclusions and directing the implementation of inspection conclusions; handling or requesting, recommending competent state agencies to handle economic violations; handling or requesting, recommending competent state agencies to handle officials and public employees with legal violations; applying or requesting, recommending competent state agencies to apply remedial measures, improving mechanisms, policies, laws.

Authority to examine and verify other agencies, organizations, units, and individuals in Vietnam

The authority to examine and verify other agencies, organizations, units, and individuals in Vietnam is regulated in Article 8 of Circular 07/2024/TT-TTCP as follows:

- During the process of inspecting the responsibilities for implementing the law on inspection, citizen reception, complaints, denunciations, and anti-corruption, based on the requirements of the inspection, besides the agencies, organizations, and individuals subject to the inspection, the Inspection Delegation has the right to review and verify other related agencies, organizations, units, and individuals to clarify the contents to be inspected.

- Agencies, organizations, units, and individuals related to the inspection content are responsible for working, reporting, explaining, and providing information and documents as required by the Inspection Delegation in accordance with the law.

Circular 07/2024/TT-TTCP takes effect in Vietnam from August 15, 2024.
