Marriage Registration Procedure

Below, the Legal Secretary would like to introduce the basic regulations regarding the conditions, documents, order, and procedures for marriage registration conducted at the Commune-level People's Committee (UBND).

Marriage Registration Conditions:

- Male individuals must be at least 20 years old, and female individuals must be at least 18 years old;- The decision to marry must be made voluntarily by both parties;- Neither party should be incapacitated in terms of civil acts;- The marriage is not under any of the prohibited circumstances such as:- Sham marriage;- Underage marriage, forced marriage, deception, preventing marriage;- Marrying another person while still having a living spouse, or marrying a person who has a living spouse while oneself is unmarried;- Marriage between people in direct bloodline; between people within three generations; between adoptive parents and adopted children; between people who were once adoptive parents and adoptive children, father-in-law and daughter-in-law, mother-in-law and son-in-law, stepfather and stepchildren, stepmother and stepchildren.

Documentation:

* Necessary Documents to Present

- Passport or identity card or citizen identification card or other documents with a photograph and personal information issued by competent authorities, which are still valid for use;- Documents proving residence to determine authority;- Extract of the divorce record for Vietnamese citizens registering residence at the commune level where they apply for marriage registration, who were previously divorced by a foreign authority.

* Documents to Submit:

- Marriage registration application according to the template. Both parties can jointly fill out one marriage registration application;- Original Certificate of Marital Status issued by the competent commune-level People's Committee;- If the person requesting marriage registration is working, studying, or laboring abroad for a determined period, they must submit a Certificate of Marital Status issued by the Vietnamese diplomatic representative agencies or consular offices abroad.

Procedure, Execution Steps:

- The person requesting marriage registration submits the application at the competent commune-level People's Committee (either party can directly submit the documents without the need for an authorization letter from the other party).- The person receiving the documents is responsible for immediately checking the entire document set, comparing the information in the Application Form, and ensuring the validity of the documents submitted or presented by the applicant.- If the documentation is complete and valid, the receiver issues a receipt, clearly stating the date and time of the results. If the documentation is incomplete or needs completion, the applicant is guided to supplement and complete it as per regulations. If it's not possible to supplement or complete the documents immediately, a written guide should be made, clearly noting the types of documents and contents needed, and signed by the receiver with their name and title.- If the guidance for supplementation isn't fulfilled adequately, the receiver rejects the document acceptance and drafts a rejection document, clearly stating the reason for rejection, and signs it with their name and title.- Right after accepting all valid documents, if all marriage conditions are met as per regulations, the civil status officer reports to the Chairman of the commune-level People's Committee. If the Chairman agrees to resolve, the civil status officer records the marriage in the Marriage Register, instructs both parties to sign the Marriage Certificate, and both parties to sign the Register. The Chairman of the commune-level People's Committee organizes the issuance of the Marriage Certificate to both parties.

* Note:

+ If the applicant submits original copies from the original register or certified copies from the original, the receiver should not request the presentation of the original; if the applicant only submits photocopies and presents the original, the receiver checks and compares the photocopies with the original, signs the photocopy confirming the comparison, and should not ask the applicant to submit certified copies of those documents.

+ If the law requires the presentation of documents during civil status registration, the receiver is responsible for checking the presented documents, comparing them with the information in the Application Form, and returning the documents to the presenter without requesting additional copies of those documents. The receiver may photograph one copy of the presented document or record the information from the presented document for archive purposes.

+ The receiver is responsible for properly receiving the complete civil status registration documentation as per civil status laws and should not request additional documents that are not legally required.

Processing Time: Within the same day of receiving the documents; if received after 15:00 hours and cannot be processed on the same day, results will be given the following business day. If further verification of the marriage conditions of both parties is needed, the processing time should not exceed 05 working days.

Receiving Office: Commune-level People's Committee where either party resides.

Fee: Free of charge.
