This is one of the notable contents stipulated in Circular 06/2013/TT-BYT issued by the Ministry of Health, guiding the implementation of a pilot project for managing drug prices using the maximum wholesale margin method for drugs funded by the state budget and health insurance.
The management of drug prices by the maximum wholesale markup method for pilot-tested drugs is implemented according to the guidelines in Article 7 of Circular 06/2013/TT-BYT as follows:

For the purchase of drugs containing active ingredients listed in the inventory of active ingredients applied on a pilot basis specified in Clause 2, Article 4 of this Circular, it must comply with the regulations of Inter-ministerial Circular 01/2012/TTLT-BYT-BTC dated January 19, 2012, by the Minister of Health and the Minister of Finance guiding the bidding for drug procurement in medical facilities, and Circular 11/2012/TT-BYT dated June 28, 2012, by the Minister of Health guiding the preparation of bidding documents for drug procurement in medical facilities.
The prices of drugs containing active ingredients applied on a pilot basis in medical examination and treatment establishments must meet the following regulations:
- The difference between the proposed winning bid price of the drugs containing active ingredients applied on a pilot basis and the original value calculated by the markup of the drug must not exceed the maximum wholesale markup specified in Appendix 3 issued with this Circular.- In cases where the drug under consideration for the winning bid (the one with the lowest evaluation price) according to the regulations of Inter-ministerial Circular 01/2012/TTLT-BYT-BTC dated January 19, 2012, by the Minister of Health and the Minister of Finance guiding the bidding for drug procurement in medical facilities, has a difference between the proposed winning bid price and the original value calculated by the markup of the drug exceeding the maximum wholesale markup specified in Appendix 3 issued with this Circular, the head of the unit conducting the pilot, as stipulated in Clause 2, Article 5 of this Circular, must negotiate with the bidder with the lowest evaluation price to ensure that this difference does not exceed the maximum wholesale markup as per regulations. In the event that price negotiations do not reach an agreement, but the drug is still essential for the unit's needs, the head of the unit must report to the Ministry of Health (Department of Drug Administration, Financial Planning Department) for consideration and resolution based on the principle of ensuring adequate drug supply for the healthcare needs of the people.
