Regulations on the Management Board of the Support Fund for Farmers in Vietnam

This content is specified in Decree 37/2023/ND-CP on the establishment, organization, and operation of the Farmers Support Fund (effective from August 8, 2023).

(1) Management Board of the Central Support Fund for Farmers has a maximum of 5 members who are officers of the Central Farmers' Union working part-time, including:

- The Chairman of the Management Board of the Central Support Fund for Farmers is the Vice Chairman of the Central Committee of the Vietnam Farmer Association;

- One member of the Management Board is the Director of the Central Support Fund for Farmers;

- The remaining members of the Management Council are appointed by the Central Standing Committee of the Farmers' Union.

(2) The Management Council of the Provincial Farmers' Support Fund has a maximum of 5 members who are officers of the Provincial Farmers' Unions working part-time, including:

- The Chairman of the Management Council of the Provincial Support Fund for Farmers is the Vice Chairman of the Provincial Farmers' Association;

- One member of the Management Board is the Director of the Provincial Support Fund for Farmers;

- The remaining members of the Management Council shall be appointed by the Standing Board of the Provincial Farmers' Union; In case of necessity, the People's Committee of the province may appoint 01 representative of the Department or branch in the locality to participate in the Management Council of the Provincial Support Fund for Farmers.

(3) The Management Board of the district-level Support Fund for Farmers has a maximum of 03 members who are officers of the district-level Farmers' Unions working part-time, including:

- The Chairman of the Management Board of the district-level Support Fund is the Vice Chairman of the District Farmers' Association;

- One member of the Management Board is the Director of the district-level Support Fund for Farmers;

- The remaining members of the Management Council are appointed by the Standing Board of the District Farmers' Association and work part-time; in necessary cases, the district-level People's Committee may appoint 01 representative of the local department to participate in the Management Board of the district-level Support Fund.

(4) The term of office of a member of the Management Board of the Support Fund for Farmers shall not exceed 5 years and may be re-appointed, but not exceeding 2 terms.

(5) Standing Committees of Farmers' Unions at all levels decide the planning, appointment, re-appointment, resignation, dismissal, transfer, rotation, commendation, and discipline for members of the Management Board of the Support Fund for Farmers at the same level who are officers of the Farmers' Associations at all levels. The President of the People's Committee of the province/district shall decide on the appointment, re-appointment, resignation, dismissal, transfer, commendation, and discipline of the members of the Management Board of the Support Fund for Farmers who are representatives of the local departments, branches/sections or departments.

(6) Criteria and conditions for appointment and re-appointment of the Chairman of the Management Board of the Support Fund for Farmers:

- Being a Vietnamese citizen, permanently residing in Vietnam, having full civil act capacity;

- Having a university degree or higher, with at least 5 years of experience (for the Central Support Fund for Farmers), 03 years (for the provincial/district Farmers Support Fund) holding a leadership and management position in one of the following fields: economy; finance; bank; agriculture and rural development; business administration; the law; accountant; audit;

- Not being the spouse, biological father, adoptive father, natural mother, adoptive mother, biological child, adopted child, sibling, brother-in-law, brother-in-law, sister-in-law, sister-in-law of the manager of the Farmer Support Fund;

- Other standards and conditions as required by the management of Farmers' Associations at all levels and prescribed in the Charter on the organization and operation of the Farmers Support Fund.

(7) Other members of the Farmer Support Fund's Management Council must have a university degree or higher and have experience in managing one of the following fields: economics, finance, banking, business administration, law, accounting, or auditing. Specific criteria and conditions for members of the Farmer Support Fund's Management Council are specified in the organization and operation charter of the Farmers Support Fund.

(8) The working regime of the Management Board is specified in the Charter of Organization and Operation of the Farmers Support Fund, ensuring the following contents:

- Meetings of the Management Board of the Support Fund for Farmers will only take effect when at least 2/3 of the members attend. In case the meeting is not organized, the collection of the opinions of the members of the Management Board shall be done in writing;

- The conclusions of the Management Board of the Farmer Support Fund are expressed in the resolutions and decisions of the Management Board;

- The Management Board of the Farmer Support Fund decides on issues by majority vote; each member of the Management Board has 1 vote with equal voting rights. Resolutions and decisions of the Management Board take effect when more than 50% of the total members of the Management Board of the Farmer Support Fund vote or collect written opinions with their approval. In case the number of votes is equal, the final decision belongs to the side with the opinion of the Chairman of the Management Board of the Support Fund for Farmers;

- The Management Board of the Support Fund for Farmers may use the seal of the Farmers Association at the same level.

(9) Duties and powers of the Management Board include:

- Receive, manage, and use the funds of the Farmers Support Fund in accordance with the provisions of law and the Charter of the organization and operation of the Farmers Support Fund; take responsibility before the Standing Board of the Farmers' Association at the same level for the performance of assigned tasks and powers;

- Develop annual, medium-term, and long-term operational and financial plans for the Farmers Support Fund and submit them to the Standing Board of Farmers' Associations at the same level for approval;

- Promulgate or amend the regulations on professional operation and other internal regulations in accordance with the provisions of the Charter on the organization and operation of the Farmers Support Fund;

- Supervise and inspect the executive board of the Farmers Support Fund in the observance of policies and laws and the implementation of decisions of the Management Board;

- Decide the lending interest rate of the Farmers Support Fund in each period according to the provisions of Article 16 of Decree 37/2023/ND-CP;

- Approve loans, decide on capital mobilization plans, and deal with risks within their competence;

- Approve financial statements, distribute income and expenditure differences, and set aside annual funds of the Farmers Support Fund after obtaining appraisal opinions of the Supervisory Board to submit to the Standing Board of Farmers' Associations at the same level for approval;

- Submit to the Standing Board of Farmers' Associations at the same level the decision to promulgate amendments and supplements to the Charter on the organization and operation of the Farmers Support Fund;

- Submit to the Standing Board of Farmers' Associations at the same level for approval of the plan to arrange personnel to establish the operational apparatus of the Farmers Support Fund;

- Issue or amend the Regulation on Operation and assign tasks to members of the Farmer Support Fund Management Council;

- Other duties and powers as prescribed in the Organization and Operation Charter of the Farmers Support Fund.

(10) Duties and powers of the Chairman of the Management Board:

- Organize the implementation of the tasks and powers of the Farmer Support Fund Management Council; assign tasks to members to perform the tasks and powers of the Farmers Support Fund Management Council according to the operation regulations of the Farmers Support Fund Management Council; take responsibility before the Standing Committee of the Farmers' Association at the same level and the Management Board of the Support Fund for Farmers for the performance of their assigned tasks and powers;

- Direct the preparation of programs and operational plans by the Management Board of the Support Fund for Farmers; the program, content, and documents of the meeting of the Management Board of the Support Fund for Farmers; the collection of opinions from the members of the Management Council on the contents related to the operation of the Support Fund for Farmers;

- Convene and chair meetings of the Management Board of the Support Fund for Farmers;

- Direct and supervise the implementation of decisions of the Management Board of the Support Fund for Farmers and the operation of the Support Fund for Farmers;

- Sign and promulgating documents under the authority of the Management Board of the Support Fund for Farmers and the Chairman of the Management Board of the Support Fund for Farmers.
