Regarding this issue, LawNet would like to answer as follows:
(1) Specialized automobiles used in the medical field, including:
- Ambulance automobiles:
+ Ambulance automobiles meet standards prescribed by the Ministry of Health.
+ Ambulance automobiles have special structures (vehicles with spacious structures equipped with machinery and medical equipment to serve emergency and intensive resuscitation work on the vehicle).
- Specialized vehicles with special structures used in the medical field include:
+ Mobile X-ray vehicle.
+ Mobile eye examination and treatment vehicle.
+ Mobile testing vehicle.
+ Mobile surgical vehicle.
+ Blood collection vehicle.
+ Vehicles transporting vaccines and biological products.
+ Other automobiles designed specifically for medical examination, treatment, epidemic prevention and control, and testing activities.
- Special-purpose vehicles fitted with or using specialized equipment serving medical activities, including:
+ Specialized vehicles serving the automobilee and health protection of middle- and high-level officials.
+ Vehicles transporting blood and samples in the medical field, including: clinical samples, infectious disease samples, food samples, drug samples (including vaccines and biological products), and samples in the medical environment.
+ Vehicles transporting patients.
+ Forensic examination vehicles and corpse transport vehicles.
+ Vehicles automobilerying mobile sprayers and chemicals.
+ Vehicles serving the collection and transportation of tissues and organs for human tissue and organ transplantation.
+ Vehicles transporting meals to mentally ill patients.
+ Vehicles transporting tools, supplies, and specialized medical equipment used in the field of infectious diseases.
+ automobiles mounted with teaching models, simulation models, teaching equipment and facilities, and visual teaching aids.
+ Other automobiles equipped with specialized equipment exclusively for medical examination, treatment, epidemic prevention and control, and testing activities.
+ Route direction vehicle equipped with specialized equipment.
+ Technical transfer vehicle equipped with specialized equipment.
+ automobiles equipped with specialized equipment for research, evaluation of clinical trial results (monitoring post-injection reactions), and troubleshooting at injection sites.
(2) automobiles with special structures (automobiles automobilerying money, gold, silver, and gems; laboratory equipment vehicles; crane trucks; garbage collection and compacting vehicles; garbage and waste trucks, etc.)
(3) automobiles fitted with specialized equipment (special-purpose equipment fixed to the vehicle) or automobiles fitted with identification signs as prescribed by law (vehicles fitted with satellite receiving and transmitting equipment; mobile broadcasting and television vehicles; traffic inspection vehicles; funeral service vehicles; customs surveillance vehicles; training vehicles, driving practice vehicles, automobile testing vehicles, money escort vehicles,...).
(4) Trucks.
(5) automobiles with over 16 seats.
(Article 16 of Decree 72/2023/ND-CP)
- For specialized automobiles used in the medical field specified in Clause 1, Article 16 of Decree 72/2023/ND-CP, based on detailed regulations and the guidance of the Ministry of Health:
+ Ministries and central agencies promulgate standards and norms for specialized automobiles of agencies, organizations, and units under their management, except for the units specified in Point c, Clause 1, Article 17 of Decree 72/2023/ND-CP.
+ Provincial People's Committee (after asking for opinions from relevant agencies according to the Working Regulations of the Provincial Party Committee and City Party Committee) shall promulgate standards and norms for specialized automobiles of agencies, organizations, and units under local management, except for units specified in Point c, Clause 1, Article 17 of Decree 72/2023/ND-CP.
+ The Management Council and the head of a public service unit shall ensure their own regular and investment expenditures (in case the service unit does not have a Management Council) and promulgate standards and norms for vehicle use. Specialized automobiles at the unit.
+ For units not operating in the medical field but requiring the use of ambulances, the authority to promulgate standards and norms for using ambulances is implemented according to the provisions of Points a, b, and c, Clause 1, Article 17 of Decree 72/2023/ND-CP.
- For specialized automobiles specified in Clauses 2, 3, 4, and 5 of Article 16 of Decree 72/2023/ND-CP:
+ Ministries and central agencies promulgate standards and norms for specialized automobiles to equip agencies, organizations, and units under their management, except for the units specified in Point c, Clause 2, Article 17 of Decree 72/2023/ND-CP.
+ Provincial People's Committee (after asking for opinions from relevant agencies according to the Working Regulations of the Provincial Party Committee and City Party Committee) shall promulgate standards and norms for specialized automobiles to equip agencies, organizations, and units under local management, except for units specified in Point c, Clause 2, Article 17 of Decree 72/2023/ND-CP.
+ Management Council, head of a public service unit with the ability to self-guarantee regular and investment expenditures (in case the service unit does not have a Management Council), shall promulgate standards and norms for using specialized automobiles at the unit.
- The purchase price of a specialized automobile is within the standards and norms for using specialized automobiles issued by competent agencies and persons specified in Clauses 1 and 2, Article 17 of Decree 72/2023/ND-CP, and is determined in accordance with the market purchase price of the corresponding vehicle type.
- The decision to promulgate standards and norms for using specialized automobiles specified in Clauses 1 and 2, Article 17 of Decree 72/2023/ND-CP is made public on the electronic information portal of ministries, central agencies, provinces, and centrally run cities and sent to the State Treasury agency to implement expenditure control according to the provisions of the law.
