On November 28, 2024, the Minister of Education and Training of Vietnam issued Circular 19/2024/TT-BGDDT, which stipulates the list and periodic rotation term for positions under the management of the education and training sector within local authorities.

List of positions in the field of education and training in Vietnam required for periodic rotation

The list of positions in the field of education and training in Vietnam required for periodic rotation includes:

- Enrollment, training at public schools.

- Allocation of targets, management of enrollment for educational institutions in the national education system; allocation of postgraduate training targets and training abroad targets at agencies and units under the local government's management authority.

- Appraisal and approval of training and development programs of educational institutions in the national education system.

- Appraisal of local education materials, documents, curricula, teaching aids, and other technical materials serving teaching and research.

- Appraisal of dossiers for establishing and licensing educational operations of educational institutions within the national education system under management.

- Management of schemes, projects in the education and training sector.

- Allocation and appraisal of scientific research topics in the education and training sector.

The term for periodic rotation of positions in the education and training sector as specified is from 3 (three) to 5 (five) years. The start date for counting the rotation term is the date of the official document regarding the mobilization, arrangement, and assignment of duties by the competent authority according to legal regulations.

Methods of implementing position rotation in Vietnam

The methods of implementing position rotation in Vietnam are regulated in Article 37 of Decree 59/2019/ND-CP as follows:

- Rotation of positions within the same expertise, profession from one department to another within the agency, organization, unit; between various fields, locations assigned for monitoring, oversight, management, or between agencies, organizations, units within the management scope of ministries, ministry-equivalent agencies, agencies under the Government of Vietnam, local government.

- Rotation of positions is carried out through an official document on mobilization, arrangement, and assignment of duties for persons with positions and authority as per legal regulations.

Cases where position rotation is not implemented in Vietnam

Cases where position rotation is not implemented include:

- Persons under consideration or disciplinary action.

- Persons under inspection, verification, audit, investigation, prosecution, or trial.

- Persons receiving treatment for critical illnesses as certified by a competent healthcare institution; persons undertaking concentrated study for 12 months or more, persons on secondment.

- Women during pregnancy or caring for children under 36 months old; men caring for children under 36 months old due to the wife's death or other objective circumstances.

Regulations on position rotation in special cases in Vietnam

Article 38 of Decree 59/2019/ND-CP stipulates the rotation of positions in special cases as follows:

- For an agency, organization, or unit with only one position in the periodic rotation list, and this position requires different expertise or profession from the remaining positions within that agency, organization, or unit, the rotation will be planned by the direct superior head.

- No position rotation is conducted for individuals with less than 18 months of remaining work time until retirement age.
