Recently, the Minister of Health of Vietnam issued a List of medicines, pharmaceutical ingredients for human use, and imported/exported cosmetics in Vietnam that have been assigned commodity codes according to the Vietnam Import-Export Commodity List.

Regarding this matter, LawNet provides the following explanation:

On June 11, 2024, the Minister of Health of Vietnam issued Circular 09/2024/TT-BYT promulgating the lists of pharmaceuticals, pharmaceutical materials for human use, and imported and exported cosmetics that have been assigned commodity codes according to the List of Vietnam's Export and Import Commodities.

The lists of pharmaceuticals, pharmaceutical materials for human use, and imported and exported cosmetics that have been assigned commodity codes according to the List of Vietnam's Export and Import Commodities are issued together with Circular 09/2024/TT-BYT (hereinafter collectively referred to as the List), including:

- List 1: List of poisonous drugs and poisonous materials for export and import that have been assigned commodity codes;

- List 2: List of export and import pharmaceutical raw materials that are narcotic substances that have been assigned commodity codes;

- List 3: List of export and import pharmaceutical raw materials that are psychotropic substances that have been assigned commodity codes;

- List 4: List of export and import pharmaceutical raw materials that are precursor substances used for pharmaceuticals that have been assigned commodity codes;

- List 5: List of export and import pharmaceuticals and pharmaceutical substances under the list of substances banned in certain sectors that have been assigned commodity codes;

- List 6: List of export and import pharmaceutical raw materials that are radioactive substances used in the medical sector that have been assigned commodity codes;

- List 7: List of export and import pharmaceutical raw materials that are pharmaceutical substances and semi-finished products that have been assigned commodity codes;

- List 8: List of export and import drugs containing a single pharmaceutical ingredient that have been assigned commodity codes;

- List 9: List of export and import combination drugs that have been assigned commodity codes;

- List 10: List of export and import vaccines that have been assigned commodity codes;

- List 11: List of export and import medicinal herbal materials that have been assigned commodity codes;

- List 12: List of export and import substances extracted from medicinal herbs and essential oils that have been assigned commodity codes;

- List 13: List of export and import traditional medicines and herbal medicines that have been assigned commodity codes;

- List 14: List of export and import cosmetics that have been assigned commodity codes.

What are principles for applying the list of pharmaceuticals, pharmaceutical materials for human use, and imported and exported cosmetics in Vietnam?

According to Article 3 Circular 09/2024/TT-BYT, the principles for applying the list of pharmaceuticals, pharmaceutical materials for human use, and imported and exported cosmetics are as follows:

- In cases of discrepancies or inconsistencies in the classification and determination of commodity codes for goods on the Lists issued together with Circular 09/2024/TT-BYT, the determination of commodity codes is carried out according to customs laws.

- For pharmaceuticals, pharmaceutical materials, and cosmetics for export and import that are not listed and have not had commodity codes determined in the Lists issued with Circular 09/2024/TT-BYT, the determination of commodity codes is carried out according to customs laws. After customs clearance, exporting and importing organizations and individuals are to send a document to the Ministry of Health (Drug Administration Department, Traditional Medicine Administration Department) as a basis for cooperation with the Ministry of Finance to consider, unify, update, and issue a supplementary list.

- Pharmaceutical substances, medicinal herbs, and substances extracted from medicinal herbs and essential oils may have other uses besides making medicines. If these products are used as medicines or raw materials for medicines, they must comply with pharmaceutical laws; if used for other purposes, they must comply with other relevant laws.

Circular 09/2024/TT-BYT takes effect from July 26, 2024.
