Regarding this issue, LawNet would like to answer as follows:
On January 22, 2024, the Minister of Finance issued Circular 04/2024/TT-BTC on guidance on leading or managerial positions and specialized officials and the structure of specialized officials in public service units in the financial sector, taking effect on March 6, 2024.
Circular 04/2024/TT-BTC applies to public service units in the financial sector under ministries and ministerial-level agencies (except the Ministry of Public Security and the Ministry of National Defense), People's Committees of provinces and centrally run cities, People's Committees of districts, towns, provincial cities, and centrally run cities (except for public service units under the management of special administrative-economic units), and related organizations and individuals. |

- Strictly implement the Party's policies and the law on job positions, the number of employees, and streamlining staff in public service units.
- Be consistent with the functions, tasks, powers, and organizational structure of the public service unit.
- Ensure scientificity, objectivity, openness, transparency, efficiency, and improve the quality of officials and workers in public service units.
- Ensure that a worker is assigned enough work to perform within the prescribed working time. Job positions that do not have enough workload to be performed within the prescribed time of one employee must be arranged part-time.
- Ensure a reasonable structure in which the number of people working in positions with specialized professional titles and shared professional titles accounts for at least 65% of the total number of people working in public service units.

The basis for determining leading or managing positions in public service units in the financial sector includes:
- Functions, tasks, powers, and organizational structure of public service units;
- Complexity, nature, characteristics, and scale of operations; scope and objects of service; professional and professional management processes according to specialized laws.
