Regarding this issue, LawNet would like to answer as follows:

On October 30, 2023, the Ministry of Education and Training issued Circular 20/2023/TT-BGDDT, providing guidance on job positions, the structure of public employees according to professional titles, and quotas on the number of people working in general education establishments and public specialized schools.

1. List of job positions; quota of people working in public elementary schools in Vietnam

1.1 List of job positions and instructions for describing job positions in public elementary schools

- The list of leadership, management positions, and specialized professional titles in elementary schools is specified in Appendix I, issued with Circular 20/2023/TT-BGDDT.

- The list of shared professional positions and support and service positions in primary schools is specified in Appendix II, issued with Circular 20/2023/TT-BGDDT.

- Instructions for the job description:

+ The description of leadership and management positions is guided by Appendix III issued with Circular 20/2023/TT-BGDDT;

- Job position descriptions with specialized professional titles in elementary schools are guided in Appendix IV issued with of Circular 20/2023/TT-BGDDT;

- The description of professional job positions for general use, support, and service in primary schools shall comply with the instructions in of Circular 20/2023/TT-BGDDT.

- Based on the instructions to describe leadership and management job positions, specialized occupational titles, shared professional job positions, and support and service positions stipulated in Clause 3, Article 5 of of Circular 20/2023/TT-BGDDT, primary schools develop specific and appropriate job position descriptions for each unit's job position and submit them to competent authorities for approval according to regulations.

1.2 Norms for the number of people working in leadership and management positions

- Principal: Each school is assigned 1 principal.

- Vice principals: the number of vice principals shall comply with the regulations on the number of deputy levels in of Circular 20/2023/TT-BGDDT.

1.3 Norms for the number of people working in specialized professional positions

- Primary school teacher job position:

+ Primary schools are allowed to arrange a maximum of 1.5 teachers/class for 2-session/day classes and a maximum of 1.2 teachers/class for 1-session/day classes;

+ Primary school, after calculating the number of students/class according to the provisions in clause (ii) section 2 or according to the provisions in clause (iv) section 2, if there is a remaining number of students for every 12 students for schools in region 1 or 15 students for schools in region 2 or 17 students for schools in region 3, 01 additional teacher will be assigned;

+ In addition to the norms prescribed above, each primary school is assigned 01 teacher to be in charge of the Ho Chi Minh Young Pioneers Team.

- Teaching job position:

+ Primary schools for people with disabilities can accommodate a maximum of 02 people;

+ The remaining primary schools are assigned 01 person;

+ In case staff cannot be arranged, labor contracts or part-time teachers and staff can be arranged;

+ In addition to the above norms, elementary boarding schools for ethnic minorities can contract additional people to perform student management tasks; Based on the scale, nature, and actual conditions, schools determine the number of labor contracts and submit them to competent authorities for approval.

- Student consulting job position: Each elementary school is assigned 01 person. In cases where staff cannot be arranged, labor contracts or part-time teachers can be arranged.

- Job positions supporting the education of people with disabilities:

+ For schools for people with disabilities at the elementary level: For every 15 students with disabilities, 01 person will be assigned;

+ For elementary schools with students with disabilities learning in integration: Schools with less than 20 students with disabilities learning in integration will be assigned 01 person; Schools with 20 or more students with disabilities studying for integration will be assigned a maximum of 02 people;

+ In case staff cannot be arranged, labor contracts or part-time teachers can be arranged.

1.4 Norms for the number of people working in shared professional positions

- Library and office administration job positions:

+ Primary schools with 28 or more classes in Region 3, with 19 or more classes in regions 1 and 2; Semi-boarding elementary schools for ethnic minorities and schools for the disabled at the elementary level can accommodate a maximum of 02 people;

+ Primary schools with 27 classes or less in Region 3, with 18 classes or less in region 1 and region 2 are assigned 01 person.

- Clerical, treasurer, and accounting positions:

+ Schools for people with disabilities at the elementary level are assigned a maximum of 03 people to perform clerical, treasurer, and accounting duties;

+ The remaining primary schools are assigned a maximum of 02 people to perform clerical, treasurer, and accounting duties;

- For job positions that cannot be staffed, the labor contract will require teachers or part-time staff to be assigned. Primary schools base their decisions on the nature, workload, and actual conditions to determine suitable job positions, the number of people working for each position, and concurrent tasks.

1.5 Support and service job positions

- Pursuant to the provisions of the law; with the size of the students, nature, workload, and actual conditions, the elementary school determines the number of contract workers for each support and service position.

- The signing of labor contracts is carried out in accordance with current legal provisions.

2. Regulations on dividing regions to calculate teacher quotas in Vietnam

According to Article 3 of Circular 20/2023/TT-BGDDT,

(i) Regulations on dividing regions to calculate teacher quotas are as follows:

- Region 1: Communes of region II and region III according to current regulations, belong to ethnic minority and mountainous areas; communes with particularly difficult coastal areas; Communes with particularly difficult socio-economic conditions; island communes, island communes, border communes, and safety zone communes according to the Government's regulations;

- Region 2: Region I communes (except wards and towns) according to current regulations belong to ethnic minority and mountainous areas;

- Region 3: Wards and towns in Region I according to current regulations in ethnic minority and mountainous areas and the remaining communes, wards, and towns.

(ii) The number of students/classes by region as a basis for assigning or approving the number of people working in general education establishments is as follows:

- Region 1: Average of 25 students/class for primary school; average 35 students/class for middle school and high school;

- Region 2: Average 30 students/class for primary school; average 40 students/class for middle and high school levels;

- Region 3: Average 35 students/class for primary school; average 45 students/class for middle and high school levels;

- The number of students/class of boarding high schools for ethnic minorities and specialized high schools shall comply with regulations in the organization and operation regulations.

(iii) Determining the number of students/class is calculated specifically for each educational institution and not determined by commune, district, or province-level administrative units.

(iv) Pursuant to the zoning regulations in Clause (i), the Provincial People's Committee directs specialized agencies to identify commune-level units for each region as a basis to calculate teacher norms for general education establishments.

For special cases where the number of students/class must be lower or higher than the regional average specified in clause (ii), the Provincial People's Committee shall decide on the number of students/class appropriate to reality.
