Basis for determining a job position includes:
- Functions, tasks, powers, and organizational structure of public service units;
- Complexity, nature, characteristics, and scale of operations; scope and objects of service; professional and professional management processes according to specialized laws.
(Clause 1 of Article 4 of Decree 106/2020/ND-CP)
(1) Public service units cover their own recurrent and investment expenditures
Pursuant to Section 2, the public service unit shall develop a job position project, organize an appraisal, and submit it to the head of the public service unit for submission to the Management Council for approval; The head of the public service unit decides to approve the job positions and employee structure according to the unit's professional title after being approved by the Management Council.
(2) Public service units cover their own regular expenses
Pursuant to Section 2 and the competent authority's guiding documents on job positions and the structure of public employees by professional title by industry and field, the public service unit develops a job position project, organizes an appraisal, and submits it to the head of the public service unit to decide whether to approve job positions and employee structure according to the professional title of the unit. taste. In the event that a public service unit has a Management Council, the head of the unit must submit it to the council for approval before deciding whether to approve job positions and employee structure by professional title.
(3) Public service units themselves cover part of their regular expenses, and public service units have their regular expenditures covered by the state budget.
- Pursuant to Section 2 and the competent authority's guiding documents on job positions and the structure of public employees by professional title by industry and field, the public service unit shall develop a job position project and report it to the direct superior agency to report to the agency or organization as prescribed in Point b of this Clause for appraisal.
- The agencies and organizations assigned with the task of organizing personnel of ministries, equivalent agencies, government agencies, organizations established by the government or the Prime Minister, which are not public non-business units, Hanoi National University, Ho Chi Minh City National University, Provincial People's Committees of centrally-run provinces and cities (hereinafter referred to as ministries, sectors, localities) or agencies and organizations delegated with the task of organizing personnel of delegated and authorized management and use positions according to the regulations shall continue to receive application dossiers, organize the evaluation of the employment position plan of public non-business units, and submit them to the competent authority for approval in accordance with the provisions at point c of this clause.
- The Minister, the Head of the equivalent agency, the Head of the government agency, the head of the organization established by the government or the Prime Minister, which is not a public non-business unit, the Director of Hanoi National University, the Director of Ho Chi Minh City National University, the Provincial People's Committee (hereinafter referred to as the Provincial People's Committee) or the agencies and organizations delegated with the task of organizing personnel of delegated and authorized management and use positions according to the regulations shall approve the employment position and the staffing structure according to the professional title of the public non-business unit within their management scope.
