Regarding this issue, LawNet would like to answer as follows:
(1) Support and training for force participants involved in protecting security and order at the grassroots level
According to Article 23 of the Law on Forces participating in protecting security and order at the grassroots level 2023, support and training for people participating in forces participating in protecting security and order at grassroots levels are as follows:
- People participating in the force and protecting security and order at the grassroots are entitled to regular monthly support, and are supported with voluntary social insurance and health insurance contributions according to the level decided by the Provincial People's Council.
- People participating in the force and protecting security and order at the grassroots are entitled to support and training when they are sent for training and performing tasks as assigned by competent authorities or when assigned or mobilized to perform tasks. The level of support and training is prescribed as follows:
+ When sent for refresher training, they will receive compensation equal to the basic food allowance of People's Public Security Service soldiers;
+ When on duty from 10:00 p.m. the previous day to 6:00 a.m. the next day, on days off or holidays, when performing heavy, toxic, dangerous, or especially heavy, toxic, dangerous work according to the provisions of labor law, they are entitled to compensation levels decided by the Provincial People's Council;
+ When on duty in border areas, islands, mountainous areas, areas with extremely difficult socio-economic conditions, and ethnic minority areas, or in commune-level administrative units that are key to national defense, they enjoy increased working day allowances decided by the Provincial People's Council;
+ When mobilized, mobilized, or sent to perform tasks outside the area of responsibility, the agency mobilizes, mobilizes, or sends them to perform the task of supporting transportation, food, and rest while on duty.
(2) Regimes and policies for force participants involved in protecting security and order at the facility who are sick, get in an accident, die, or are injured while performing their duties
According to Article 24 of the Law on Forces participating in protecting security and order at the grassroots level 2023, benefits and policies for force participants participating in protecting security and order at the facility who are sick, get in an accident, die, or are injured while performing their duties are as follows:
- People who have participated in social insurance or health insurance and are eligible to receive insurance will be paid benefits from the insurance fund according to the provisions of the law.
- People who do not participate in health insurance but are sick, have an accident, or are injured will receive support to pay for medical examinations and treatment costs.
- People who have not participated in social insurance but have an accident that reduces their working ability according to the conclusion of the Medical Examination Council will be considered for benefits depending on the level of reduced working ability; If you die, your relatives will receive survivor benefits and funeral expenses.
- People who are injured or die while performing their duties will be considered for benefits and policies like war invalids, or they will be considered for recognition as martyrs and enjoy other rights according to the provisions of the law.
Pursuant to Article 4 of the Law on Forces participating in protecting security and order at the grassroots level 2023, the principles of organization and operation of the forces participating in protecting security and order at the grassroots level are as follows:
- Complying with the Constitution and laws; protecting and ensuring human rights and civil rights; protecting the interests of the state and the legitimate rights and interests of organizations and individuals; relying on the People and being subject to People's supervision.
- Being subject to the comprehensive leadership of the Party Committee and the management of the Commune People's Committee; the guidance, assignment, and inspection of the Commune-level Police in performing tasks according to the provisions of this Law.
- Meeting requirements for protecting security and order; suitable to the socio-economic conditions of each locality.
- No gender discrimination in forces participating in protecting security and order at the grassroots level.
