Legal Form, Legal Entity Status, and Functions, Duties of VIETTEL

Enclosed with this Decree is the Charter of organization and operation of the Parent Company - Military Industry and Telecommunications Group, which prescribes the legal form, legal status, functions, and tasks of VIETTEL. To be specific:

1. Legal form, legal status of VIETTEL

- VIETTEL is a defense and security enterprise, with 100% charter capital owned by the State, established by the Prime Minister of the Government of Vietnam, directly managed by the Ministry of National Defense; operating under the provisions of the Law on Enterprises, relevant legal regulations, regulations of the Ministry of National Defense, and the Charter;- VIETTEL has legal status, its own seal, and its own Charter of organization and operation; it is permitted to open accounts at the State Treasury, domestic and foreign commercial banks in accordance with the law;- VIETTEL has ownership rights over its trade names and trademarks in accordance with the law;- VIETTEL has its own capital and assets and is responsible for its debts and other property obligations with its entire assets.

2. Main functions and tasks of VIETTEL

- Regarding defense and security:

- Directly build, manage telecommunications network infrastructure, ensure that VIETTEL's telecommunications network infrastructure serves as a backup for the military communication network in peacetime and switches to serve defense and security in case of emergencies; be ready to ensure communication when required and fulfill other military communication tasks;- Research, design, manufacture, assemble, repair products, equipment, defense supplies according to the requirements and tasks assigned by the State and the Ministry of National Defense.

- Regarding production and business:

- Directly conduct production and business activities in the assigned sectors and industries, in combination with financial investment functions in accordance with the law;- Invest in subsidiaries, affiliated companies domestically and internationally; control subsidiaries through capital, operations, technology, brand, market, or other forms in accordance with the law and the Charter issued with Decree 05/2018/ND-CP;- Exercise the rights and obligations of the owner of VIETTEL's capital in subsidiaries and affiliated companies, and exercise VIETTEL's rights and obligations according to affiliate contracts with voluntarily affiliated companies.
