Legal Assistants Are Prohibited from Colluding with Authorities to Break the Law

Recently, the Ministry of Justice issued Circular 03/2020/TT-BTP promulgating the Professional Code of Ethics for Legal Aid.

According to Circular 03/2020/TT-BTP, when interacting with competent authorities conducting legal proceedings, persons with authority to conduct legal proceedings, other agencies, organizations, and individuals, the legal aid provider must:

- Behave appropriately, in accordance with legal provisions, ensuring cooperation, politeness, and respect towards persons with authority to conduct legal proceedings or persons with authority related to the case and legal aid work.- Coordinate promptly with competent authorities conducting legal proceedings, persons with authority to conduct legal proceedings during the resolution of the case and legal aid work.- Do not conspire, lure, or incite persons with authority to conduct legal proceedings, individuals in agencies, or organizations related to the case to act against legal regulations.- Do not by oneself or incite the legally aided person to provide information, documents, and evidence known to be untrue related to the case and legal aid work, or carry out fraudulent acts and other illegal acts that cause difficulties and obstruct the resolution of the case and legal aid work by competent authorities, organizations, and individuals./.

Additionally, according to this rule, the legal aid provider must perform the case and legal aid work with dedication, responsibility, and promptly apply the necessary measures and skills in accordance with legal provisions to best protect the legitimate rights and interests of the legally aided person. Maintain confidentiality of information about the case and legal aid work; about the legally aided person that becomes known during the legal aid provision process and even when the case and legal aid work have concluded, except in cases where there is written consent from the legally aided person or other legal provisions.

Do not use the information obtained during the legal aid provision process to disadvantage the legally aided person, disrupt public order and safety, or negatively affect social morals.
