Lease Agreement for Old Residential Property with a Maximum Term of 5 Years

This is a notable new point in Decree 30/2019/ND-CP amending and supplementing certain articles of Decree 99/2015/ND-CP on the implementation of the Housing Law.

To be specific: according to Decree 30/2019/ND-CP, the term of the lease contract for old housing is 5 years, starting from the date of signing the lease contract. If the tenant needs a shorter lease term, the lease contract will be signed according to that need.

When the lease term expires, and the tenant still meets the conditions for renting the house and wishes to continue renting, the lease contract may be extended for the same duration as the previous lease term, except in cases where the house is reclaimed according to regulations.

Also, according to Decree 30/2019, the time to resolve the lease of old housing is no more than 30 days, from the date of receiving the complete dossier.
