Regarding this issue, LawNet would like to answer as follows:

On March 6, 2024, the Government issued Decree 29/2024/ND-CP regulating standards for leading and managing positions for officials in state administrative agencies in Vietnam .

Leading positions for officials in state agencies in Vietnam under Decree 29/2024/ND-CP

Specifically, leading positions for officials in state agencies, under Decree 29/2024/ND-CP, include:

(1) For the Ministry:

- Deputy Minister, Deputy Head of ministerial-level agencies (hereinafter collectively referred to as Deputy Minister);

- Director of the Department, Director of the Department, Chief of the Ministry Office, Chief Inspector of the Ministry (hereinafter referred to as the Director of the Department and equivalent in the Ministry);

- Deputy Director, Deputy Director, Deputy Chief of the Ministry Office, Deputy Chief Inspector of the Ministry (hereinafter referred to as Deputy Director and equivalent in the Ministry);

- Head of department under Department, Department, Ministry Office, Ministry Inspectorate; Chief of Office of the Department under the Ministry, Chief Inspector of the Department, Director of the Branch of the Department under the Ministry (hereinafter collectively referred to as Head of Department and equivalent under the Ministry);

- Deputy Head of Department, Department, Ministry Office, Ministry Inspectorate; Deputy Chief of Department Office under the Ministry, Deputy Chief Inspector of the Department, Deputy Director of Branches under the Department under the Ministry (hereinafter referred to as Deputy Head of Department and equivalent under the Ministry);

- Head of department and equivalent in a Branch of a Department under the Ministry;

- Deputy Head of Department and equivalent in a Branch of a Department under the Ministry.

(2) For General Department and equivalent under the Ministry:

- Director General and equivalent;

- Deputy Director General and equivalent;

- Director of Department, Director of Department, Chief of Office, Chief Inspector of General Department (hereinafter referred to as Director of Department and equivalent under General Department);

- Deputy Director General, Deputy Director General, Deputy Chief of Office, Deputy Chief Inspector of the General Department (hereinafter referred to as Deputy Director General and equivalent under the General Department);

- Head of Department, Office, General Department Inspectorate; Chief of the Department Office under the General Department, Head of the Department under the General Department (hereinafter referred to as Head of Department and equivalent under the General Department);

- Deputy Head of Department, Office, General Department Inspectorate; Deputy Chief of Department Office under the General Department, Deputy Head of Department under the General Department (hereinafter referred to as Deputy Head of Department and equivalent under the General Department);

- Head of department and equivalent of a Branch under a Department under the General Department;

- Deputy Head of Department and equivalent in a Branch of a Department under the General Department.

(3) For Departments and equivalents:

- Director of the Department, Chief of the Office of the National Assembly Delegation and People's Council, Chief of the Office of the Provincial People's Committee, Chief of the Provincial Inspectorate, Head of the Ethnic Affairs Committee (hereinafter referred to as Department Director and equivalent);

- Deputy Director of the Department, Deputy Chief of the Office of the National Assembly Delegation and People's Council, Deputy Chief of the Office of the Provincial People's Committee, Deputy Chief of the Provincial Inspectorate, Deputy Head of the Ethnic Affairs Committee (hereinafter referred to as Deputy Director of the Department and equivalent);

- Head of Department, Head of Department, Head of Department under the Department; Head of Department under the Office of the National Assembly Delegation and People's Council, Head of Department under the Office of the Provincial People's Committee, Chief of the Department Office, Chief Inspector of the Department, Head of the Department for Ethnic Minorities Affairs
(hereinafter referred to as Head of Department and equivalent under the Department);

- Deputy Head of Department, Deputy Head of Department, Deputy Head of Department under the Department; Deputy Head of the Office of the National Assembly Delegation and People's Council, Deputy Head of the Office of the Provincial People's Committee, Deputy Head of the Department Office, Deputy Chief Inspector of the Department, Deputy Head of the Department for Ethnic Minorities (hereinafter referred to as Deputy Head of Department and equivalent under the Department);

- Head of Department and equivalent of a Branch or Board of the Department (hereinafter referred to as Head of Department and equivalent of a Branch of the Department);

- Deputy Heads of Departments and equivalents of Branches and Boards of the Department (hereinafter referred to as Deputy Heads of Departments and equivalents of Branches of the Department).

(4) For department levels and equivalents under district-level People's Committees:

- Chief of Office of the People's Council and People's Committee, Head of Department under the District People's Committee (hereinafter referred to as Head of Department and equivalent in the district);

- Deputy Chief of Office of the People's Council and People's Committee, Deputy Head of Department under the district People's Committee (hereinafter referred to as Deputy Head of Department and equivalent in the district).

(5) Positions and titles specified in (1), (2), (3), and (4) are determined according to the organizational structure of that agency or organization according to the provisions of law.

Positions and titles in other state administrative agencies and organizations are established according to the provisions of the law, determined by the name of the agency, organization, or unit, and considered equivalent to the appropriate position, title according to the management level or according to the decision of the competent authority.

(6) Leadership and management positions and titles at the National Assembly Office and the President's Office; Government agencies; the assisting administrative apparatus of the Supreme People's Court, the Supreme People's Procuracy, the State Audit, and agencies under the management authority of the National Assembly Standing Committee will apply according to the provisions of Article 3 Decree 29/2024/ND-CP.

(6) Leadership and management positions and titles under the Ministry of National Defense and the Ministry of Public Security comply with the Party's regulations and specialized laws; apply the provisions of this Decree according to the decisions of the Minister of National Defense and the Minister of Public Security.
