Law on Youth 2020: Ministry of Home Affairs Responsible for Implementing State Management on Youth

This is a notable provision stipulated in the Youth Law 2020 issued on June 16, 2020, which took effect on January 1, 2021. This law stipulates that the Ministry of Home Affairs is responsible to the Government of Vietnam for performing state management on youth.

To be specific, Law on Youth 2020 amends the provisions on state management (State management) content regarding youth and the responsibilities of the Government of Vietnam and the Ministry of Home Affairs in implementing state management on youth, which were not clearly stipulated in the Law on Youth 2005, specifically:

1. Content of State management on youth

- Enacting or submitting for enactment to competent state authorities legal documents on youth; stipulating measures to implement policies for youth.- Developing and implementing strategies, policies, programs, and plans for youth development.- Conducting statistics, information dissemination, and reporting on the status of youth and the implementation of policies and laws concerning youth.- Building a team of officials engaged in state management on youth.- Propagating, disseminating, and educating policies and laws on youth.- Inspecting, examining, handling violations, resolving complaints, denunciations, and recommendations; summarizing and evaluating, rewarding in the implementation of policies and laws concerning youth.- International cooperation on youth.- Enacting policies to support and encourage organizations and individuals to participate in the implementation of policies concerning youth.

2. Responsibilities of the Government of Vietnam

The Government of Vietnam uniformly manages the State on youth and has the following responsibilities:

- Ensuring the effective implementation of state management content on youth;- Ensuring the mechanism and measures for coordination among Ministries, equivalent agencies, etc., in developing and implementing policies and laws on youth;- Ensuring the development and implementation of goals and targets for youth development in long-term, medium-term, and annual socio-economic development strategies, programs, and plans of the nation, sector, and field;- Reporting the results of policy and law implementation concerning youth as required by the National Assembly.

3. Responsibilities of the Ministry of Home Affairs

The Ministry of Home Affairs is responsible before the Government of Vietnam for implementing state management on youth and has the following responsibilities:

- Enacting according to authority or submitting for enactment to competent state authorities policies and laws on youth; strategies, programs, and plans for youth development;- Proposing the integration of policies, targets, and goals for youth development when developing policies, strategies, programs, and socio-economic development plans for the sector and field.- Guiding Ministries, equivalent agencies, and provincial People's Committees in performing state management tasks on youth; organizing training and improving knowledge and skills for officials engaged in state management on youth;- Leading, cooperating with relevant agencies in managing, exploiting, and publishing data on youth, and youth development indexes;- Leading, cooperating with Ministries, equivalent agencies, Government agencies, and the Central Committee of the Ho Chi Minh Communist Youth Union in developing and implementing policies and laws concerning youth;- Inspecting, examining, resolving complaints, denunciations, and recommendations; summarizing, evaluating, rewarding, and handling violations within authority or recommending competent agencies, organizations, or individuals to handle violations in the implementation of policies and laws concerning youth;- Reporting to the Government of Vietnam on the results of policy and law implementation concerning youth and state management tasks on youth;- Leading, cooperating with relevant agencies in managing international cooperation activities on youth according to the provisions of law.

Additionally, Articles 39 and 40 of the Law on Youth 2020 detail the responsibilities of Ministries, equivalent agencies, and provincial People's Councils and People's Committees within their tasks and powers, cooperating with the Ministry of Home Affairs in implementing state management on youth.
